RESOLUTION 2004-10 <br />APPROVING A CONDITIONAL USE PERMIT FOR GENE'S DISPOSAL <br />SERVICE, INC. PROPERTY LOCATED AT 5661152ND STREET NORTH. <br />WHEREAS, Gene and Lisa Wegleitner have requested approval of a conditional use <br />permit to allow exterior storage in an area exceeding the size of the principal building and <br />operate a recycling center on a 1.6 -acre property legally described as follows: <br />Insert Legal <br />WHEREAS, the Planning Commission has reviewed the conditional use permit at a duly <br />called Public Hearing and recommends approval, and; <br />NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF <br />THE CITY OF HUGO, MINNESOTA, that it should and hereby does approve the <br />request by Gene and Lisa Wegleitner for a conditional use permit, subject to the <br />following conditions: <br />1. The conditional use permit is approved in accordance with the plans and application <br />received by the City on January 29, 2004, except as amended by this resolution. <br />2. The portion of the site on which the sorting and storage of recyclable material will <br />occur must be protected by a concrete pad or bituminous, as approved by the City. <br />3. Vehicles shall be stored inside the building or on an improved surface, such as <br />bituminous and concrete. <br />4. Areas of the site not covered with buildings or improved surfaces should be <br />landscaped. A landscape plan should be submitted for staff review and approval. <br />5. A contiguous and uniform fence that is effective in visually screening the property <br />from adjacent properties and the public right-of-way shall surround the entire <br />property. The applicant shall erect a fence of the same type and height along the <br />border of the property that is not currently fenced and replace the plastic slats in the <br />existing fence so that the fence is contiguous and uniform in its screening <br />effectiveness. A revised site plan shall be submitted for City review and approval. <br />6. The site currently contains debris that shall be removed by the applicant before <br />beginning operations. <br />7. Storing and storage of materials and containers shall only be permitted in the areas <br />identified in the approved site plan. <br />8. All recycling materials must remain in covered containers. No outside storage of <br />recycling shall be permitted. <br />9. The site must be maintained in a clean, odor -free manner at all times. The applicant <br />shall be responsible for maintaining a site free of litter and debris. <br />
