RESOLUTION 2004-19 <br />APPROVING A PUD AMENDMENT FOR POA-SCHERER, LLC. FOR <br />"VICTOR GARDENS COMMUNITY ACTIVITY CENTER" ON OUTLOT B OF <br />VICTOR GARDENS 2" ADDITION <br />WHEREAS, POA -Scherer, LLC. has requested approval of a PUD Amendment to allow <br />construction of a community activity center with a pool on property legally described as <br />follows: <br />Oudot B, Victor Gardens 2"d Addition. <br />WHEREAS, the Planning Commission has reviewed the PUD amendment for the <br />community activity center at a duly called Public Hearing and recommends approval, <br />and; <br />NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF <br />THE CITY OF HUGO, MINNESOTA, that it should and hereby does approve the <br />request by POA -Scherer, LLC. for a PUD general plan amendment, subject to the <br />following conditions: <br />1. A PUD amendment is approved to allow the construction of a community activity <br />center with a pool, in accordance with the plans received on March 4, and revised on <br />March 25, 2004, except as amended by this resolution. <br />2. The PUD amendment is approved based on the finding that the proposed project is <br />consistent with the City's Comprehensive Plan and the approved Victor Gardens <br />PUD. <br />3. A conditional use permit is approved to allow the encroachment of the pool into the <br />floodplain, based on the finding that the proposed project meets all standards and <br />criteria required by Section 1155.030 of the Land Use Regulations and the following: <br />a. The developer must comply with floodplain use construction standards as <br />required by Subd. 5 of Section 1155-030.1. <br />b. An elevation certificate must be provided. <br />4. The applicant shall provide copies of section of the HOA documentstcovenants which <br />cover the pool for City review. <br />5. Prior to final approval, detailed building elevations for all sides of the building should <br />be provided for City review. All building elevations shall receive nearly equal <br />treatment and visual qualities. <br />
