RESOLUTION 2004 - 20 <br />A RESOLUTION ASSUMING THE SOLE PERMIT AUTHORITY TO ISSUE PERMITS <br />FOR AND REGULATE ACTIVITIES AFFECTING WATER RESOURCES WITHIN THE <br />CITY OF HUGO <br />WHEREAS, Minnesota Rules Chapter 8410 and 8420 and Minnesota Statue 103B outline the <br />requirements and responsibilities of a municipality undertaking local water resource management; <br />and <br />WHEREAS, the City of Hugo meets the requirements to assume water resources permitting role <br />pursuant to Minnesota Statute 103B; and <br />WHEREAS, the City of Hugo will provide knowledgeable and trained staff to manage Water <br />Resources permitting and/or will secure a qualified delegate; and <br />WHEREAS, the City of Hugo will temporarily adopt Rice Creek Watershed District's (RCWD) <br />Rules regarding stormwater management (Rule C), floodplain alteration (Rule E), and wetland <br />alteration (Rule F) as City's ordinances (#2004-386, #2004387, #2004-388) by reference until such <br />time that the City adopts ordinances related to these programs; and <br />WHEREAS, The RCWD has accepted the existing City ordinances regarding erosion control and <br />shoreland development in accordance with the MOU; and <br />WHEREAS, the City of Hugo will follow the requirements outlined in Minnesota Rules Chapter <br />8410, 8420 and Minnesota Statute 103B in the administration of local water resource management; <br />and <br />WHEREAS, the Memorandum of Understanding dated April 28, 2004 between the Rice Creek <br />Watershed District and the City of Hugo defines the terms by which authority pursuant to Minnesota <br />Statute 103B can be transferred to the City of Hugo; and <br />WHEREAS, the City of Hugo held a public hearing on May 3, 2004 to receive input from any <br />interested parties; and <br />NOW, THEREFORE, BE IT RESOLVED, the City of Hugo assumes the role of water resource <br />permitting authority effective immediately upon adoption for this resolution. <br />Passed and adopted this 3rd day of May 2004. <br />ay <br />ATTEST: <br />Mary reager, City Clerk <br />AI.SKAMVResoludons12004 LGUResoludomdoc <br />
