RESOLUTION 2004-21 <br />APPROVING A COMPREHENSIVE PLAN AMENDMENT FOR POAC-CRAIN, <br />LLC. FOR "VICTOR GARDENS 4TH ADDITION" ON PROPERTY LOCATED <br />AT THE SOUTHWEST QUADRANT OF EVERTON AVENUE NORTH AND <br />FRENCHMAN ROAD (COUNTY ROAD 8) <br />WHEREAS, the POAC-Crain, LLC. has requested a comprehensive plan amendment to <br />change the 20.37 -acre residential portion of the site from Commercial to High -Density <br />Residential, with respect to the 23.64 -acre property, legally described as follows: <br />That part of the Southeast Quarter of the Northwest Quarter of Section 19, Township <br />31 North, Range 21 West, Washington County, Minnesota, lying Southerly of the <br />center line of Frenchman Road North (a/k/a County State Aid Highway No. 8). <br />WHEREAS, the Planning Commission has reviewed said request at a duly called public <br />hearing and recommends approval. <br />NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF <br />THE CITY OF HUGO, MINNESOTA, that it should and hereby does approve the <br />request for a comprehensive plan amendment for the above -referenced property, based on <br />the following findings and subject to the following conditions: <br />1. The property is located with the urban service area where municipal sewer and <br />water are available. <br />2. The property is unique with regard to its physical characteristics and the wetland <br />locations within the site that lends itself less to commercial development than <br />residential. <br />3. There is adequate commercial land remaining in other areas to meet the needs of <br />the City. <br />4. There is adequate public infrastructure to serve the site. <br />5.
