RESOLUTION 200424 <br />APPROVING PRELIMINARY PLAT FOR POAC-CRAIN, LLC. FOR "VICTOR <br />GARDENS 4TH ADDITION" ON PROPERTY LOCATED AT THE <br />SOUTHWEST QUADRANT OF EVERTON AVENUE NORTH AND <br />FRENCHMAN ROAD (COUNTY ROAD 8) <br />WHEREAS, POAC-Crain, LLC. has requested approval of a preliminary plat to allow <br />construction of 92 townhome units on the 23.64 -acre property legally described as <br />follows: <br />That part of the Southeast Quarter of the Northwest Quarter of Section 19, <br />Township 31 North, Range 21 West, Washington County, Minnesota, <br />lying Southerly of the center line of Frenchman road North (a/k/a County <br />State Aid Highway No. 8). <br />WHEREAS, the Planning Commission has reviewed the preliminary plat at a duly called <br />Public Hearing and recommends approval, and; <br />NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF <br />THE CITY OF HUGO, MINNESOTA, that it should and hereby does approve the <br />request by POAC---Crain, LLC for a preliminary plat, subject to the following <br />conditions: <br />1. A preliminary plat is approved to allow the creation of 10 townhome lots, 9 common <br />lots and 2 commercial lots in accordance with the plans and application received by <br />the City on March 22, 2004, except as amended by this resolution. <br />2. Approval is contingent upon City Council approval of the comprehensive plan <br />amendment from Commercial to High Density Residential. <br />3. Approval is contingent upon City Council approval of the rezoning from C-2 to PUD. <br />4. Approval is contingent upon the City Council approval of the requested PUD <br />amendment. <br />5. Development standards shall be as approved as part of the PUD. <br />6. The park dedication shall be cash -in -lieu of dedication and shall be due prior to filing <br />the final plat. <br />7. The developer must obtain all necessary permits from Rice Creek Watershed District. <br />8. The development shall comply with the Fire Chief's requirements regarding fire flow <br />calculations, the location of fire hydrants, fire department connections, and fire lane <br />signage. <br />
