RESOLUTION 2004-25 <br />APPROVING FINDINGS OF FACT FOR REZONING FOR CENTEX HOMES <br />AND PRATT INVESTMENT FOR 333 -UNITS ON THE POWERS/NEESER <br />PROPERTY LOCATED EAST OF ELMCREST AVENUE, WEST OF EVERTON <br />AVENUE AND NORTH OF COUNTY ROAD 8 <br />WHEREAS, Centex Homes and Pratt Investment have requested reclassification of the <br />zoning from Future Urban Reserve to PUD (planned unit development) for a 125.28 -acre <br />parcel, legally described as follows: <br />The southwest quarter of the northwest quarter and the north half of the southwest <br />quarter, Section 18, Township 31 North, Range 21 West, located in Washington <br />County, Minnesota. <br />Together with <br />The southeast quarter of the northwest quarter of Section 18, Township 31 North, <br />Range 21 West, Washington County, Minnesota <br />WHEREAS, the Planning Commission has reviewed the request at a duly called Public <br />Hearing and recommends approval, and; <br />WHEREAS, the City Council has adopted an ordinance rezoning the affected parcel from <br />Future Urban Reserve to PUD; <br />NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF <br />THE CITY OF HUGO, MINNESOTA, that it should and hereby does support the request <br />by Centex Homes and Pratt Investment for the reclassification of the zoning from Future <br />Urban Reserve to PUD for the 125.28 -acre property, based on the following findings: <br />1. The proposed rezoning would be consistent with the Comprehensive Plan, which <br />allows low density development (2-3 units per net acre) and density bonuses up to <br />4 units per acre. The development would allow townhomes and single family <br />homes at a net density of 3.38 units per acre. <br />2. The PUD will allow a more creative and efficient approach to land use within the <br />City, while at the same time protecting and promoting the health, safety, comfort, <br />aesthetics, economic viability and general welfare of the City. <br />3. The proposed development meets the intent of the PUD zoning district by <br />providing appropriate transitions between differing land uses within the site and <br />adjacent land uses, provides a landscaped streetscape, park land and land for the <br />school/community playfields. <br />
