RESOLUTION 200440 <br />APPROVING A MINOR SUBDIVISION FOR TOM LACASSE ON PROPERTY <br />LOCATED AT 13375 ELMCREST AVENUE NORTH <br />WHEREAS, an application has been filed by Tom LaCasse that requests approval of a <br />minor subdivision for property located at 13375 Elmcrest Avenue North; <br />WHEREAS, the subject property is legally described as follows: <br />That part of the Northwest Quarter of the Southwest Quarter of Section 30, Township 31 <br />North, Range 21 West, Washington County, Minnesota, described as: <br />Beginning at a point on the west line of said Section 30, distant 100 feet northerly of the <br />northwest corner of the south 250 feet of said Northwest Quarter of the Southwest <br />Quarter; thence northerly along said west line 250 feet, more or less, to the north line of <br />the south 600 feet of said Northwest Quarter of the Southwest Quarter, thence easterly <br />along said north line 633 feet, more or less, to the east line of the west 633 feet of said <br />Northwest Quarter of the Southwest Quarter, thence easterly along said north line to the <br />east line of said Northwest Quarter of the Southwest Quarter; thence westerly along said <br />north line to the east line of the west 525 feet of said Northwest Quarter of the Southwest <br />Quarter; thence northerly along said east line 10 feet ;thence northwesterly to the point <br />of beginning. Subject to Elmcrest Avenue North. <br />WHEREAS, the Planning Commission has reviewed said request at a duly called Public <br />Hearing and recommends approval, and; <br />NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF <br />THE CITY OF HUGO, MINNESOTA, that it should and hereby does approve the minor <br />subdivision for Tom LaCasse, subject to the following conditions: <br />1. A minor subdivision is approved in accordance with the plans and application <br />received by the City on April 7, 2004, except as amended by this resolution. <br />2. The property is subject to the development standards of the R-3 zoning district. <br />3. The City code requires new lots in the MUSA to be served by municipal utilities. The <br />applicant may either pay a cash escrow for the future road and utility improvements, <br />or enter into an assessment agreement for the future improvements. The assessment <br />agreement, among other things, will require the property owner to waive all rights to <br />appeal any future assessments under Minnesota Statues 429. <br />4. Prior to recording the subdivision, the developer shall pay the park dedication fees in <br />lieu of land dedication, pursuant to the Dedication Policy in effect at the time of <br />recording the subdivision.
