RESOLUTION 2004-51 <br />APPROVING PRELIMINARY PLAT FOR POA-SCHERER, LLC. FOR <br />"VICTOR GARDENS SOUTH VILLAGE" ON PROPERTY LOCATED SOUTH <br />OF FRENCHMAN ROAD (COUNTY ROAD 8) AND WEST OF EVERTON <br />AVENUE NORTH <br />WHEREAS, POA -Scherer, LLC. has requested approval of a preliminary plat to allow <br />construction of 14 townhome units and 4 commercial lots on the 12.62 -acre property <br />legally described as follows: <br />Outlot A, Victor Gardens 2"d Addition <br />And <br />Outlot A, Victor Gardens P Addition <br />WHEREAS, the Planning Commission has reviewed the preliminary plat at a duly called <br />Public Hearing and recommends approval, and; <br />NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF <br />THE CITY OF HUGO, MINNESOTA, that it should and hereby does approve the <br />request by POA-SCHERER, LLC for a preliminary plat, subject to the following <br />conditions: <br />1. A preliminary plat is approved to allow the creation of 14 townhomes and 4 <br />commercial lots in accordance with the plans and application received by the City on <br />June 11, 2004, except as amended by this resolution. <br />2. Approval is contingent upon the City Council approval of the requested PUD <br />amendment. <br />3. Development standards shall be as approved as part of the PUD. <br />4. The park dedication requirements for this site were met with previous phases of the <br />development. <br />5. The developer must obtain all necessary permits from the City. <br />6. The development shall comply with the Fire Chief s requirements regarding fire flow <br />calculations, the location of fire hydrants, fire department connections, and fire lane <br />signage. <br />7. Comply with all conditions outlined in the City Engineer's memo dated June 18, <br />2004. <br />ADOPTED by the City Council this 6h day of July 2004. <br />ATTEST: <br />Mary AfCreager, City C CA <br />
