RESOLUTION 2004-52 <br />APPROVING FINDINGS OF FACT DENYING THE COMPREHENSIVE PLAN <br />AMENDMENT FOR ONKEKA LAKE DEVELOPMENT COMPANY, LLC, FOR <br />APPROXIMATELY 69 ACRES OF PROPERTY LOCATED NORTH AND <br />SOUTH OF ONEKA LAKE BOULEVARD AND EAST OF GREENE AVENUE <br />WHEREAS, Oneka Lake Development Company, LLC has requested approval of a <br />Comprehensive Plan Amendment regarding property legally described as follows: <br />See Attached <br />WHEREAS, the property is currently located outside the Metropolitan Urban Service <br />Area (MUSA), <br />WHEREAS, the applicant has requested that the MUSA boundary be extended around <br />the subject property, <br />WHEREAS, the Planning Commission has reviewed the Comprehensive Plan <br />Amendment at a duly called Public Hearing and recommends denial, and; <br />NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF <br />THE CITY OF HUGO, MINNESOTA, that it should and hereby does deny the <br />comprehensive plan amendment, based on the finding contained in the staff report dated <br />June 30, 2004, including the following: <br />1. Limited available sanitary sewer capacity <br />2. The property is not contiguous to the existing MUSA, and would require the <br />inclusion of the adjacent properties along Greene Avenue <br />3. The property is not uniquely situated. There are numerous other properties <br />located outside the MUSA with similar circumstances, including property <br />adjacent to the subject tract. If this property is included within the MUSA, it may <br />lead to additional requests from landowners to be included within the MUSA. <br />other property, which could lead to additional request <br />4. There is exiting vacant land within the MUSA that could accommodate the <br />proposed development. <br />5.
