RESOLUTION 2004-52 APPROVING FINDINGS OF FACT DENYING THE COMPREHENSIVE PLAN AMENDMENT FOR ONKEKA LAKE DEVELOPMENT COMPANY, LLC, FOR APPROXIMATELY 69 ACRES OF PROPERTY LOCATED NORTH AND SOUTH OF ONEKA LAKE BOULEVARD AND EAST OF GREENE AVENUE WHEREAS, Oneka Lake Development Company, LLC has requested approval of a Comprehensive Plan Amendment regarding property legally described as follows: See Attached WHEREAS, the property is currently located outside the Metropolitan Urban Service Area (MUSA), WHEREAS, the applicant has requested that the MUSA boundary be extended around the subject property, WHEREAS, the Planning Commission has reviewed the Comprehensive Plan Amendment at a duly called Public Hearing and recommends denial, and; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF HUGO, MINNESOTA, that it should and hereby does deny the comprehensive plan amendment, based on the finding contained in the staff report dated June 30, 2004, including the following: 1. Limited available sanitary sewer capacity 2. The property is not contiguous to the existing MUSA, and would require the inclusion of the adjacent properties along Greene Avenue 3. The property is not uniquely situated. There are numerous other properties located outside the MUSA with similar circumstances, including property adjacent to the subject tract. If this property is included within the MUSA, it may lead to additional requests from landowners to be included within the MUSA. other property, which could lead to additional request 4. There is exiting vacant land within the MUSA that could accommodate the proposed development. 5. The property can be put to reasonable use without an amendment to the Comprehensive Plan.
