RESOLUTION 2004-59 <br />APPROVING A CONDITIONAL USE PERMIT FOR A WIND POWERED <br />GENERATOR AT 7310132ND STREET NORTH. <br />WHEREAS, Greg Johnson has requested a conditional use permit to allow for the <br />construction of a wind -powered generator <br />See Exhibit A <br />WHEREAS, the Planning Commission has reviewed the request at a duly called Public <br />Hearing and recommends approval, and; <br />NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF <br />THE CITY OF HUGO, MINNESOTA, that it should and hereby does approve the <br />request by Greg Johnson for a conditional use permit, subject to the following conditions: <br />1. The conditional use permit amendment is approved in accordance with the <br />application received by the City on May 4, 2004. <br />2. The tower shall be constructed as a monopole, be limited to 100 -feet in height, and <br />shall contain no antennas or other equipment not related to the generator. <br />3. Prior to erecting the tower, the applicant shall obtain a building permit. <br />4. Prior to the issuance of a building permit, information shall be provided to the City to <br />ensure compliance with the construction standards outlined in Section 1195-720.1, <br />Subd. 4 of the Comprehensive Land Use Regulations. <br />5. Prior to the issuance of a building permit, the applicant shall provide proof of liability <br />insurance in the amount of $500,000. <br />6. The generator shall be maintained in a state of good repair such that it will not <br />generate usually high levels of noise. If at any time, the generator produces usually <br />high levels of noise, the generator shall be turned off until satisfactory repairs have <br />been made. <br />ADOPTED by the City Council this 2nd day of August 2004. <br />1 <br />Mayor <br />ATTEST: <br />Mary VCreager, City Cl <br />
