. 6 <br />CITY OF HUGO <br />WASHINGTON COUNTY, MINNESOTA <br />RESOLUTION 2004 - 60 <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HUGO <br />RELATING TO ACQUISITION OF NECESSARY RIGHT OF WAY AND <br />EASEMENTS IN CONNECTION WITH THE CSAH 8/14 IMPROVEMENT <br />PROJECT <br />WHEREAS, the City of Hugo, the City of Lino Lakes, Washington County and <br />Anoka County are engaged in planning for the improvement and reconstruction of <br />County State Aid Highway 8/14. These improvements are undertaken because the <br />existing roadway was constructed 35 years ago, the pavement condition and its alignment <br />have become safety concerns, the in-place roadway lacks sufficient bicycle and <br />pedestrian access, access spacing is not acceptable and the accident rate on the road <br />exceeds permissible thresholds; and <br />WHEREAS, the redesign and reconstruction of the road requires the acquisition <br />of property for purposes of right-of-way, ponding and the creation of necessary arterial <br />roadways, among other things. In addition, the construction of the road corridor triggers <br />the need for the City of Hugo to construct related and integrated arterial roadways and <br />attendant improvements such as storm water ponding areas and to acquire right-of-way <br />and easements for these purposes; and <br />WHEREAS, acquisition of the main roadway corridor right of way within the <br />City of Hugo and its attendant improvements such as storm water ponding areas will <br />likely be spearheaded by Washington County. In that regard, Washington County will be <br />identifying and describing necessary easements, negotiating with property owners, and <br />enlisting appraisers, experts and legal counsel to undertake condemnation in those <br />instances where agreed-upon acquisition is not possible. In some cases, the property <br />which Washington County will acquire is contiguous to, part of, or located very nearby <br />the property which Hugo must acquire because of the road improvement project; and <br />WHEREAS, since the resources necessary to acquire easements and right -of- way <br />will be employed by Washington County in any event, it is obvious that administrative <br />efficiency and significant financial savings would be achieved if acquisition of all <br />necessary lands to be acquired by Washington County and Hugo were consolidated with <br />and coordinated by Washington County and its consultants. This would eliminate <br />duplication of costs, duplication of staff time (including that of surveyors, appraisers, <br />attorneys, right-of-way agents), eliminate the need for duplicative court filings for <br />acquisition of properties which are often contiguous, ensure proper compliance with <br />deadlines and centralize property acquisition efforts. <br />
