RESOLUTION 2004-68 <br />APPROVING FINAL PLAT AND DEVELOPMENT AGREEMENT FOR POA <br />SCHERER, LLC FOR VICTOR GARDENS SOUTH VILLAGE ON PROPERTY <br />LOCATED SOUTH OF FRENCHMAN ROAD (COUNTY ROAD 8) AND WEST <br />OF EVERTON AVENUE NORTH. <br />WHEREAS, POA -Scherer, LLC of Minnesota has requested approval of a Final Plat for <br />"Victor Gardens South Village" on property legally described as follows: <br />Outlot A, Victor Gardens 2nd Addition <br />And <br />Oudot A, Victor.Gardens. P Addition <br />WHEREAS, the City has prepared a development agreement covering the improvements <br />related to said plat; <br />NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF <br />THE CITY OF HUGO, MINNESOTA, that it should and hereby does approve the final <br />plat for POA -Scherer, LLC for Victor Garden South Village, and <br />FURTHER, that the development agreement for said final plat be approved, and that the <br />Mayor and City Administrator be authorized to execute the development agreement on <br />behalf of the City; and <br />FURTHER, that the following conditions be met prior to recording the final plat: <br />1. A final plat is approved to allow the construction of 14 townhome units, 4 <br />commercial lots, and two outlots in accordance with the plans received by the <br />City on August 30, 2004, except as amended by this resolution. <br />2. The development agreement must be executed by the developer and the City prior <br />to release of the final plat. <br />3. Cross access and maintenance agreements shall be recorded with the final plat for <br />all shared private driveways or streets. <br />FURTHER, that the following conditions be met prior to issuance of building permits: <br />1. HOA documents must be filed at Washington County. <br />2. The plans must be revised to comply with all conditions in the City Engineer's <br />memo dated September 1, 2004. <br />
