RESOLUTION 2004-71
APPROVING FINDINGS OF FACT DENYING VARIANCES TO EXCEED THE
MAXIMUM PERMITTED DRIVEWAY WIDTHS FOR PROPERTY LOCATED
AT 15340,15352, AND 15360, GOODVIEW AVENUE NORTH.
WHEREAS, Graphic Homes has requested variances to exceed the maximum driveway
widths of 24 feet for driveways on property described as follows:
Lots 6, 7, and 8, Block 1, Oneka Ponds, Washington County.
WHEREAS, the Board of Zoning Adjustments and Appeals has reviewed the variance at
a duly called public meeting, and;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF
THE CITY OF HUGO, MINNESOTA, that it should and hereby does deny the variances
requested by Graphic Homes, Inc. on properties located at 15340, 15352, and 15360
Goodview Avenue North based on the following findings:
1. The applicant has not identified a unique hardship that would warrant the granting
of the requested variances.
2. The strict enforcement of the ordinance would not cause undue hardship because
a 24 foot driveway is adequate to access a garage.
3. The applicant's desire to have additional driveway widths is a self-created
hardship and is not unique to this individual parcel.
4. Homes in residential districts are constructed with driveways at a maximum width
of 24 feet as measured at the right-of-way and often widen beyond that point to
the width of the garage. The variances for the driveways would not be consistent
with other homes in the neighborhood.
ADOPTED by the City Council this 2& day of Septemb
o Mayor
ATTEST:
Mary& Creager, City Cl
