RESOLUTION 2004-74 <br />APPROVING FINAL PLAT AND DEVELOPMENT AGREEMENT FOR POA- <br />SCHERER, LLC. FOR VICTOR GARDENS 5t6 ADDITION ON PROPERTY <br />LOCATED EAST OF EVERTON AVENUE NORTH AND SOUTH OF <br />FRENCHMAN ROAD <br />WHEREAS, POA -Scherer, LLC. has requested approval of a Final Plat and Development <br />Agreement for "Victor Gardens P Addition" on property legally described as follows: <br />Oudot C, Victor Gardens 1" Addition, according to the recorded plat <br />thereof, Washington County, Minnesota, excepting therefrom, that part <br />platted as Victor Gardens 2°d Addition, according to the recorded plat <br />thereof, said Washington County, Minnesota. <br />WHEREAS, the City has prepared a development agreement covering the improvements <br />related to said plat; <br />NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF <br />THE CITY OF HUGO, MINNESOTA, that it should and hereby does approve the final <br />plat for POA -Scherer, LLC for Victor Gardens 5" Addition; and <br />FURTHER, that the development agreement for said final plat be approved, and that the <br />Mayor and City Administrator be authorized to execute the development agreement on <br />behalf of the City; and <br />FURTHER, that the following conditions be met prior to recording the final plat: <br />1. A final plat is approved in accordance with the plans and application received by <br />the City on August 18, 2004 and revised on September 20, 2004, except as <br />amended by this resolution. <br />2. The placement of fill material in the floodway is prohibited. The grading plan <br />should be revised to eliminate any grading within the area. The silt fence should <br />be located outside of the floodway to protect it from grading impacts due <br />to construction of the proposed trail. <br />3. HOA documents must be filed at Washington County with the final plat. <br />FURTHER, that the following conditions be met prior to issuance of building permits: <br />1. Development standards shall be according to the rezoning, PUD general plan and <br />preliminary plat approvals granted by the City Council on May 3, 2004. <br />2. The developer shall work with the City to revise the shape of the center island in <br />the cul-de-sac at the end of Street B. <br />
