RESOLUTION 2004-86 <br />APPROVING PRELIMINARY PLAT FOR STEPHEN W. SHEA FOR <br />"O'SHEA'S IRISH RIDGE" FOR PROPERTY LOCATED IN THE <br />SOUTHWEST QUADRANT OF 155TH STREET NORTH AND IRISH AVENUE <br />NORTH. <br />WHEREAS, Stephen W. Shea has requested approval of a preliminary plat to allow <br />construction of 4 single-family homes on a 41.83 -acre property legally described as <br />follows: <br />That part of the SW '/ of Section 14, Township 31, Range 21, Washington <br />County, Minnesota, lying westerly of the center line of Irish Avenue North <br />and its Northerly extension, lying North of the South 1400.00 feet thereof <br />and except the following: <br />Commencing at the Northwest corner of said SW % of Section 14; thence <br />East along the North line of said SW % of Section 14, a distance of 418.00 <br />feet to the point of beginning of the land to be described; thence <br />continuing East, along said North line, 660.00 feet; thence South, at right <br />angles to said North line 264.00 feet; thence West at right angles, 660.00 <br />feet; thence North, at right angles, 264.00 feet to the point of beginning. <br />WHEREAS, the Planning Commission has reviewed the preliminary plat at a duly called <br />Public Hearing and recommends approval, <br />NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF <br />THE CITY OF HUGO, MINNESOTA, that it should and hereby does approve the <br />request by Stephen W. Shea for a preliminary plat, subject to the following conditions: <br />1. A preliminary plat is approved to allow the creation of 4 single-family lots in <br />accordance with the plans and application received by the City on October 21, 2004, <br />except as amended by this resolution. <br />2. The development is subject to the Agricultural district standards; no variances are <br />granted or implied. <br />3. Prior to release of the final plat for filing, the applicant must comply with the <br />following conditions: <br />a. Provide a 25 -foot trail and landscaping easement. <br />b. The applicant must obtain all necessary permits from Rice Creek Watershed <br />District and the wetland LGU prior to approval of the final plat. <br />c. The plat must be revised to identify the required drainage and utility easement <br />language on the plat. <br />
