RESOLUTION 2004-92 <br />APPROVING FINAL PLAT AND DEVELOPMENT AGREEMENT FOR <br />WATERS EDGE NORTH SF, LLC FOR WATERS EDGE SECOND ADDITION <br />WHEREAS, Waters Edge SF, LLC has requested approval of a Final Plat for "Waters <br />Edge Second Addition" on property legally described as follows: <br />Outlot B and Outlot G, Waters Edge, Washington County, Minnesota according <br />to the plat thereof <br />WHEREAS, the City has prepared a development agreement covering the improvements <br />related to said plat; <br />NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF <br />THE CITY OF HUGO, MINNESOTA, that it should and hereby does approve the final <br />plat for Waters Edge SF, LLC for Waters Edge Second Addition; and <br />FURTHER, that the development agreement for said final plat be approved, and that the <br />Mayor and City Administrator be authorized to execute the development agreement on <br />behalf of the City; and <br />FURTHER, that the following conditions be met prior to recording the final plat: <br />1. A final plat is approved to allow the construction of 64 single family homes, in <br />accordance with the plans received by the City on November 3, 2004 and <br />revisions received on December 3, 2004, except as amended by this resolution. <br />2. The development agreement must be executed by the developer and the City prior <br />to release of the final plat. <br />3. Development standards shall be according to the PUD general plan and <br />preliminary plat approvals granted by the City Council on December 15, 2003, <br />and as may be amended. <br />4. The architectural controls shall be finalized for City review and filed with the <br />HOA documents. <br />5. The developer must provide easement documents for off-site construction of the <br />parkway. <br />6. The plans must be revised to comply with all conditions in the City Engineer's <br />memo dated December 14, 2004. <br />7. Drainage and utility easements shall be provided as noted in the City Engineer's <br />memo dated December 14, 2004. <br />FURTHER, that the following conditions be met prior to issuance of building permits: <br />
