A RESOLUTION 2003 -1 APPROVING CONDITIONAL USE PERMIT AND VARIANCE FOR DAVID BERTULEIT FOR A LATE MODEL AND CLASSIC MOTOR VEHICLE SALES BUSINESS ON PROPERTY LOCATED AT 15775 FOREST BOULEVARD NORTH WHEREAS, a conditional use permit and variance application has been filed by David Bertuleit that requests approval for a late model and classic motor vehicle sales business on property located at 15775 Forest Boulevard North, as legally described as follows: See attached Exhibit A. WHEREAS, the Planning Commission has considered the request at a public meeting and recommends approval. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF HUGO, MINNESOTA, that it should and hereby does approve the conditional use permit and variance for David Bertuleit, subject to the following conditions: 1. A conditional use permit and variance is approved for late model and classic motor vehicle sales business according to the application and plans dated October 17, 2002. 2. There shall be no more than two cars on display at any given time, and no more than five cats associated with the auto sales business stored on the property. 3. The auto sales business shall consist of late model/classic automobiles and trucks only. 4. The applicant shall install and maintain an opaque fence to screen the rear storage area by June 1, 2003. 5. The applicant shall plant two trees in the front yard by June 1, 2003. 6. The applicant shall pave the display area and install curb stops by July 1, 2003. 7. The applicant shall remove the weeds from the front yard and maintain turf or native grasses/flowers by June 1, 2003. 8. There shall be no parking or display of vehicles in the public right-of-way. 9. The hours of operation for the auto sales business shall be limited to 9:00 a.m. to 6:00 p.m. Monday through Friday, and 10:00 a.m. to 3:00 p.m. on Saturday. ADOPTED by the City Council on January 6, 2003.
