RESOLUTION 2003-14 <br />APPROVING PROPERTY LINE ADJUSTMENT FOR TIMOTHY AND <br />WALTER.STOLTZMAN FOR PROPERTY LOCATED AT THE SOUTHWEST <br />CORNER OF 157TH STREET AND INGERSOLL AVENUE <br />WHEREAS, an.application has been filed by Timothy and Walter Stoltzman that requests <br />approval of a property .line adjustment for property located at the southwest corner of <br />157d' Street and Ingersoll Avenue.. <br />WHEREAS, the Walter Stoltzman property is legally described as follows: <br />All that part of the SEI/4 of the NEI/4 of Section 15, T31N, R21W, City of <br />Hugo, Washington County, Minnesota, lying West of the East 985 feet thereof. <br />Together with all that part of said SEI/4 of the NEI/4 which lies easterly of the <br />above described parcel of land and westerly of a line drawn parallel with an 594.26 feet <br />easterly of the West -line of said SE1/4 of the NE1/4. <br />Both parcels being subject to the right of way of 15741 Street North over the <br />Northerly portion thereof. <br />Containing 18.00 acres, 784082 square feet, and subject to all easements and <br />restriction of record. <br />WHEREAS, the. Timothy Stoltzman property is described as follows: <br />All that part of the SEI/4 of the NEI/4 Section 15, T31N, R21W, City of Hugo, <br />Washington County, Minnesota, except for that part of the SEI/4 of the NEI/4 of Section <br />15, T31N, R21W, City of Hugo, Washington County, Minnesota lying west of the east <br />985 feet thereof. <br />Also excepting all that part of said SEI/4 of the NEI/4, which lies westerly of a <br />line drawn parallel with, and 594.26 feet easterly of the west line of the said SEI/4 of the <br />NEI/4. <br />Being subject to the right of way of 15741 Street North over the Northerly portion <br />thereof and the right of way of Ingersoll Avenue North over the easterly portion thereof. <br />Together with the NEI/4 of the SEI/4 of Section 15, T31N, R21W, City of Hugo, <br />Washington County, Minnesota. <br />Containing . 61.43 acres, 2675902 square feet, and subject to all easement and <br />restriction of record. <br />WHEREAS, the City Council has fully considered the request for the property line <br />adjustment. <br />WHEREAS, the City Council finds that the lot line adjustment will not expand or <br />intensify the nonconformity of the existing automobile repair business. <br />NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF <br />THE CITY OF HUGO, MINNESOTA, that it should and hereby does approve the <br />property line adjustment for Timothy and Walter Stoltzman. <br />ADOPTED by the City Council on March 3, 2003A <br />"May4 <br />ATTEST: <br />Mary t�Creager, City Cler <br />
