RESOLUTION 2003-15 <br />APPROVING A LOT SPLIT FOR DON HAUBLE ON PROPERTY LOCATED <br />NORTH OF 125m STREET AND EAST OF HIGHWAY 61. <br />WHEREAS, an application has been filed by Don Hauble that requests approval of a lot <br />split for property located north of 12P Street and east of Highway 61; <br />WHEREAS, the subject property is legally described as follows: <br />Insert Legal <br />WHEREAS, the Planning Commission has reviewed said request at a duly called Public <br />Hearing and recommends approval, and; <br />NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF <br />THE CITY OF HUGO, MINNESOTA, that it should and hereby does approve the lot <br />split for Don Hauble, subject to the following conditions: <br />1. A lot split is approved in accordance with the plans and application received by the <br />City on January 13, 2003, except as amended by this resolution. <br />2. The property is subject to the development standards of the R-3 zoning district. <br />3. The City code requires new lots in the MUSA to be served by municipal utilities. The <br />applicant may either pay a cash escrow for the future road and utility improvements, <br />or enter into an assessment agreement for the future improvements. The assessment <br />agreement, among other things, will require the property to waive all rights to appeal <br />any future assessments under Minnesota Statues 429. <br />4. Prior to recording the subdivision, the developer shall pay the park dedication fees in <br />lieu of land dedication, pursuant to the Dedication Policy in effect at the time of <br />recording the subdivision. Park dedication fees shall only apply to the eastern lot. <br />ADOPTED by the City Council on March 3, 200; <br />ATTEST: <br />Mary reager, City Clerk <br />
