's RESOLUTION 2003 -17 APPROVING A CONDITIONAL USE PERMIT AMENDMENT FOR A LANDSCAPE SUPPLY BUSINESS AND GARDEN CENTER ON PROPERTY LOCATED AT 5885-165m STREET NORTH WHEREAS, Kieger Enterprises, Inc. has an existing conditional use permit for an environmental clean-up business, including vehicle repair facilities, cold storage, exterior storage of vehicles and equipment, and company offices and has made application to allow a landscape supply business and garden center on property legally described as follows: That part of the southeast quarter of the Section 8, Township 31 North, Range 21 West, Washington County, Minnesota WHEREAS, the Planning Commission has reviewed said request at a duly called public meeting and recommends approval of the conditional use permit amendment. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCII. OF THE CITY OF HUGO, MINNESOTA, that it should and hereby does approve the conditional use permit for Kieger Enterprises on property located at 5885-165"' Street North subject to the following conditions: 1. The use must not have sewage disposal needs which exceed three residential equivalencies as determined by Metropolitan Council Environmental Services standards. 2. The property must meet the Dimensional Requirements for Standard Development outlined in Figure 3-2 of the City's Comprehensive Land Use Regulations. 3. No land use may produce obnoxious or continuous smoke, as measured at the point of emission, by any means. All emissions shall comply with Minnesota Rules, Chapter 7011. 4. All landscaping indicated on the Site Plan dated February 14, 2000 (revised June 15, 2000) must be maintained in accordance with the requirements of Section 5.18 of the City's Comprehensive Land Use Regulations. 5.
