RESOLUTION 2003-30 <br />APPROVING FINDINGS OF FACT DENYING VARIANCES TO EXCEED THE <br />MAXIMUM SIZE PERMITTED FOR AN ACCESSORY BUILDING AND <br />EXTERIOR FINISH REQUIREMENTS FOR RAYMOND BEHM ON <br />PROPERTY LOCATED AT 6310132ND STREET NORTH <br />WHEREAS, Raymond Behm has requested variances to exceed the accessory building <br />size standards and exterior finish requirements on property legally described as follows: <br />That part of the S1/2 of the S1/2 of the NW1/4 of the SWI/4, Sec. 28, T31, <br />R21 W. <br />WHEREAS, the Board of Zoning Adjustments and Appeals has reviewed the variance at <br />a duly called public meeting, and; <br />NOW, THEREFORE, BE 1T HEREBY RESOLVED BY THE CITY COUNCIL OF <br />THE CITY OF HUGO, MINNESOTA, that it should and hereby does deny the variances <br />requested by Raymond Behm on property located at 6310 132"d Street, based on the <br />following findings: <br />1. The applicant has not identified a unique hardship that would warrant the granting <br />of the requested variances. The applicant canenjoy a reasonable use of the <br />property with the existing home and 1,950 square foot accessory building. <br />2. The applicant's desire to have additional accessory building space is a self-created <br />hardship and is not unique to this individual parcel. <br />3. The requested variances are not keeping with the spirit and intent of the <br />ordinance. The City limits the size of accessory buildings in the Rural Residential <br />zoning district to ensure that the principal use of a property remains residential. <br />Further, the size restriction helps to limit the amount of impervious surface, <br />thereby controlling surface water runoff. The requested variances would allow <br />the applicant to have a total of 4,110 square feet of accessory buildings on this <br />five -acre parcel, where the ordinance limits the combined size to 2,300 square feet <br />4. The variances would allow an additional 1,810 square feet of accessory building <br />space on this five -acre parcel. The proposed building would be visible from <br />Goodview Avenue and 132nd Street and would not be compatible with the <br />general character of this rural residential area. <br />ADOPTED by the City Council this 16`x' day of June 2003. ` <br />'r <br />.N?,—Mayor <br />ATTEST: <br />2� I<W� <br />Mary A reager, City Clerko <br />
