RESOLUTION 2003-31 <br />APPROVING A COMPREHENSIVE PLAN AMENDMENT FOR EMMERICH <br />DEVELOPMENT CORPORATION FOR PROPERTY LOCATED ON BOTH <br />SIDES OF GOODVIEW AVENUE, SOUTH OF 145M AVENUE <br />WHEREAS, the Emmerich Development Corporation has requested a comprehensive <br />plan amendment to add property to the Metropolitan Urban Service Area (MUSA), with <br />respect to the 239 -acre site, legally described as follows: <br />The south half of the south half of the southeast quarter of the northwest quarter of <br />Section 21, Township 31, Range 21 together with an easement over the north 33 feet <br />of the east 1940 feet of the southwest quarter of Section 21, Township 31, Range 21 <br />for purposes of ingress and egress. <br />AND <br />The southwest quarter of Section 21, Township 31, Range 21. <br />WHEREAS, the Planning Commission has reviewed said request at a duly called public <br />hearing and recommends approval. <br />NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF <br />THE CITY OF HUGO, MINNESOTA, that it should and hereby does approve the <br />request for a comprehensive plan amendment for the above -referenced property, based on <br />the following findings and subject to the following conditions: <br />1. Approval of this comprehensive plan amendment is contingent upon, and subject <br />to, the required review and response by the Metropolitan Council. <br />2. Approval is contingent upon reconstruction of Goodview Avenue to provide <br />access to the site. <br />3. The property is located with the Urban Reserve, which is intended to allow urban <br />land use pending the availability of municipal services such as sewer and water. <br />4. The property is unique with regard to its development potential and the <br />contiguous natural resources such as, jurisdictional wetlands and public waters <br />that will be protected. <br />5. The property has proximity to existing urban development and appears to have <br />predicable, logical development potential. <br />6. The unique physical characteristics of the site (wetlands and public waters) would <br />constitute an eastern termination of urbanization. This statement is validated by <br />the fact that the property is substantially confined or contained by jurisdictional <br />wetlands and/or public waters. <br />
