RESOLUTION 2003-36 <br />APPROVING A COMPREHENSIVE PLAN AMENDMENT FOR THE CITY OF HUGO <br />FOR PROPERTY LOCATED SOUTH OF 165m BETWEEN ONEKA LAKE AND <br />HIGHWAY 61 <br />WHEREAS, the City of Hugo has proposed a comprehensive plan amendment to add property to the <br />Metropolitan Urban Service Area (MUSA), legally described as follows: <br />Insert Legal <br />WHEREAS, the Planning Commission has reviewed said request at a duly called public hearing and <br />recommends approval. <br />NOW, THEREFORE, BE Tr HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />HUGO, MINNESOTA, that it should and hereby does approve the request for a comprehensive plan <br />amendment for the above -referenced property, based on the following findings and subject to the <br />following conditions: <br />1. Approval of this comprehensive plan amendment is contingent upon, and subject to, the <br />required review and response by the Metropolitan Council. <br />2. The sewer plan is hereby amended to allow the subject property to be served from the <br />north, west, or south depending on which direction sewer first becomes available. In order for sewer <br />to be considered available, there must be adequate capacity and depth. <br />3. The property is located with the Urban Reserve, which is intended to allow urban land <br />use pending the availability of municipal services such as sewer and water. <br />4. The MUSA adjustment will connect the inconsistency between the City's zoning map and <br />its comprehensive plan that was created' when the City adopted a new zoning map in 1999. <br />5. The City requested that the landowners in the subject area fund a storm water drainage <br />study with the understanding that their properties would be included in the MUSA. While the <br />properties were rezoned in 1999 upon completion of the study, the comprehensive plan was never <br />amended to include the property in the MUSA. <br />6. The property has proximity to existing urban development and appears to have <br />predicable, logical development potential. <br />7. Adequate public infrastructure will be available to serve the site. <br />8.
