RESOLUTION 2003-59 <br />APPROVING FINDINGS OF FACT FOR REZONING FROM AGRICULTURAL <br />TO LONG TERM AGRICULTURAL AND CERTIFYING PROPERTY <br />ELIGIBLE FOR DESIGNATION AS AGRICULTURAL PRESERVE FOR <br />PROPERTY LOCATED NORTH OF COUNTY ROAD 57 AND EAST OF <br />JEFFREY AVENUE <br />WHEREAS, Edmund Tschida has requested reclassification of the zoning from <br />Agricultural to Long Term Agricultural for an 80 -acre parcel, legally described as <br />follows: <br />The West 1/2 of the Northeast 1/a, Section 13, T31N-R21W, Washington County, <br />Minnesota. <br />WHEREAS, the Planning Commission has reviewed the rezoning at a duly called Public <br />Hearing and recommends approval of the rezoning, and; <br />WHEREAS, the Planning Commission fmds that the property should be certified eligible <br />for designation as agricultural preserve, and; <br />WHEREAS, the City Council has adopted an ordinance rezoning the affected parcel from <br />Agricultural to Long Term Agricultural; and <br />NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL, OF <br />THE CITY OF HUGO, MINNESOTA, that it should and hereby does certify the <br />property eligible for designation as agricultural preserve and approves the reclassification <br />of the zoning from Agricultural to Long Term Agricultural, based on the following <br />findings: <br />1. The proposed rezoning is consistent with the Comprehensive Plan and other City <br />policies and plans, because the rezoning would help preserve agricultural land in an <br />area of the City designated as permanent rural. <br />2. The property is eligible for inclusion in the Metropolitan Agricultural Preserves <br />program as outline in Section 473H of the State Statutes. <br />3. The property contains a single family home, agriculture land, and vacant natural <br />areas. These land uses are consistent with the proposed zoning. <br />4.
