RESOLUTION 2002-28 <br />APPROVING A FINAL PLAT AND DEVELOPMENT AGREEMENT FOR <br />CENTEX HOMES FOR CLEARWATER CREEK ON PROPERTY LOCATED <br />WEST OF FENWAY BOULEVARD AND NORTH OF 132ND STREET NORTH <br />WHEREAS, Centex Homes has requested approval of a final plat to allow construction <br />of eighteen condominium lots and three outlots on property legally described as follows: <br />Outlot B, Woods of Bald Eagle Lake, according to the recorded plat thereof, Washington <br />County, Minnesota, except that part platted as Townhomes of Bald Eagle Lake, <br />according to the recorded plat thereof, Washington County, Minnesota. <br />WHEREAS, the City has prepared a development agreement covering the improvements <br />related to said plat; <br />NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF <br />THE CITY OF HUGO, MINNESOTA, that it should and hereby does approve the final <br />plat for Centex Homes for Clearwater Creek; and <br />FURTHER, that the development agreement for said plat be approved, and that the <br />Mayor and City Administrator be authorized to execute the development agreement on <br />behalf of the City; and, <br />FURTHER, that the following conditions be met prior to recording the final plat: <br />1. A final plat is approved to allow the creation of eighteen condominium lots and three <br />outlots, in accordance with the plans received by the City on May 23, 2002 and June <br />6, 2002, except as amended by this resolution. <br />2. The development agreement must be executed by the developer and the City prior to <br />release of the final plat for filing. <br />3. Development standards shall be as required by the R-5 district, except as otherwise <br />noted in the site plan and variance approvals granted by the City Council on April 15, <br />2002. <br />4. An 8 -foot bituminous trail shall be provided in the locations shown on the plans. The <br />developer shall provide a trail easement to ensure that a minimum of six feet of <br />planting space is retained in the boulevard between the trail and the street. The plans <br />shall be revised accordingly. <br />5. The developer shall construct the City trail. The trail shall be constructed to City <br />standards. <br />
