RESOLUTION 2002- 29 <br />APPROVING FINAL PLAT AND DEVELOPMENT AGREEMENT FOR POA <br />SCHERER, LLC. AND ROTTLUND HOMES FOR VICTOR GARDENS td <br />ADDITION ON PROPERTY LOCATED SOUTH OF CSAH 8 AND EAST OF <br />EXISTING ELMCREST AVENUE NORTH <br />WHEREAS, POA-SCHERER, LLC. And Rottlund Homes have requested approval of a <br />final plat and development agreement to allow construction of 70 townhome units on <br />property legally described as follows: <br />Outlots C, D, and L, Victor Gardens <br />NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF <br />THE CITY OF HUGO, MINNESOTA, that it should and hereby does approve the final <br />plat and development agreement for POA, Scherer, LLC and Rottlund Homes on <br />property located south of CSAH 8 and east of Elmcrest Avenue, subject to the following <br />conditions: <br />1. A final plat is approved to allow the creation of 70 units and two outlots, in <br />accordance with the revised plans received by the City on June 21, 2002, except as <br />amended by this resolution. <br />2. The development agreement must be executed by the developer and the City prior to <br />release of the final plat for filing. <br />3. The intersection with CSAH 8 will not generate enough traffic to warrant a traffic <br />signal with the second phase of the development. The need for a traffic signal will be <br />reviewed with each subsequent phase or earlier if there is a documented traffic or <br />safety problem at the intersection. The applicant is responsible for the full cost of a <br />temporary signal or two legs of a permanent signal. <br />4. The development shall comply with the Fire Chief's requirements regarding fire flow <br />calculations, the location of fire hydrants, fire department connections, and fire lane <br />signage. <br />ADOPTED by the City Council this 1 st day of July, 2002. <br />ran ' on, Mayor <br />ATTEST: <br />Mary eager, City Clerk <br />
