41 <br />Resolution 2002-33 <br />Page 2 <br />5. The following structural setbacks shall apply: <br />a. 25 feet from all public streets <br />b. 10 feet from the north property line <br />6. The maximum driveway curb cut width shall be 24 feet. <br />7. The internal public street shall be permitted with a 50 -foot right of way and 28 - <br />foot wide paved surface. <br />8. The right-of-way shown for Carl's Circle shall be eliminated and platted as part of <br />the adjacent Outlot B property. <br />9. The developer shall provide, a trail easement between the southern cul de sac and <br />the planned trail on 140th Street. The 30 -foot trail easement shall be located <br />between Lot 16 and Lot 17, Block 1. A trail shall be constructed when the trail on <br />140`h Street is constructed. <br />10. When 140th Street is constructed, a trail will be constructed on the north side of <br />the street as shown on the applicant's plans. <br />11. The developer is responsible for the full cost of the lift station construction. <br />12. The plans shall note the ordinary high water and 100 -year high water elevation for <br />all water bodies. <br />13.
