CITY OF HUGO <br />RESOLUTION 2002-34 <br />APPROVING A PRELIMINARY PLAT FOR KETTLER CONSTRUCTION FOR <br />PROPERTY LOCATED AT THE NORTHWEST QUADRANT OF THE <br />INTERSECTION OF FENWAY BOULEVARD AND THE FUTURE 140TH <br />STREET NORTH <br />WHEREAS, Kettler Construction has requested approval of a preliminary plat for <br />property legally described as follows: <br />Parcel 1: Part of the southeast % of the southeast % of Section 19, Township 31, <br />Range 21, being the north 310 feet of the south 670 feet of the west 687.58 feet of <br />the east 787.58 feet. <br />Parcel 2: Part of the southeast % of the southeast % of Section 19, Township 31, <br />Range 21, being the south 515 feet except the north 155 feet of the east 787.58 <br />feet and except the east 50 feet of the north 327 feet of the south 360 feet thereof. <br />WHEREAS, the Planning Commission has reviewed said request at a duly called Public <br />Hearing and recommends approval, and; <br />NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF <br />THE CITY OF HUGO, MINNESOTA, that it should and hereby does approve the <br />request by Kettler Construction for a preliminary plat, subject to the following <br />conditions: <br />1. A preliminary plat is approved to allow the creation of 34 twinhome lots, two <br />common lots and two outlots, in accordance with the plans and application received <br />by the City on March 15, 2002 and revision received on May 31, 2002, except as <br />amended by this resolution. <br />2. Approval is contingent upon City Council approval of the rezoning from R-3 to PUD. <br />3. Development standards shall be as approved as part of the PUD. <br />4. The right-of-way shown as Carl's Circle shall be removed and the area shall be <br />platted as part of the adjacent Outlot B. <br />5. The maximum driveway curb cut width shall be 24 feet. <br />6. The developer shall revise the plans to eliminate any grading for the proposed <br />treatment pond in the 140u' Street right-of-way. If the developer cannot provide the <br />necessary capacity and pond grading on-site, they should expand the pond to the east. <br />
