RESOLUTION 200242 <br />APPROVING FINDINGS OF FACT DENYING THE CONDITIONAL USE <br />PERMIT AND PRELIMINARY PLAT FOR NORTH SUBURBAN <br />DEVELOPMENT FOR ONEKA LAKE VIEW SOUTH ON PROPERTY <br />LOCATED SOUTH OF ONEKA LAKE BOULEVARD BETWEEN GENEVA <br />AND GOODVIEW AVENUE <br />WHEREAS, North Suburban Development has requested approval of a conditional use <br />permit and preliminary plat to allow six twinhome units on property legally described as <br />follows: <br />Outlot B, Oneka Lake View <br />WHEREAS, the Planning Commission has reviewed the site plan at a duly called Public <br />Hearing and recommends denial, and; <br />NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF <br />THE CITY OF HUGO, MINNESOTA, that it should and hereby does deny the <br />conditional use permit and preliminary plat for Oneka Lake View South, based on the <br />finding contained in the staff report dated July 5, 2002, including the following: <br />1. The common driveway would encroach into the drainage and utility easement <br />over the north 12 feet of the parcels. It is not possible to move the driveway 12 <br />feet to the south to eliminate the encroachment because of the amount and <br />location of wetlands on each lot. <br />2. The proposed lots are inconsistent with the spirit and intent of the ordinance, <br />because over 90 percent of each lot is wetland. This condition provides no usable <br />yard space or other area for accessory residential uses. <br />3. The proposed twinhomes are incompatible with the adjacent single family homes <br />located on the south side of Oneka Lake Boulevard. While there are townhomes <br />on the north side of Oneka Lake Boulevard, staff finds that the presence of these <br />townhomes does not make the proposed twinhome units compatible with the <br />surrounding area. The City often uses public streets as transitions between <br />different intensities of land uses. In this particular case, Oneka Lake Boulevard <br />helps to provide the appropriate transition between the single family homes to the <br />south and the townhomes to the north. The construction of the proposed <br />twinhomes on the south side of Oneka Lake Boulevard would disrupt this orderly <br />transition. <br />4. The proposed development does not have adequate access. The applicant is <br />proposing a shared private driveway to serve the six units in lieu of a public <br />street. The 14 -foot wide driveway would create an unsafe situation for the future <br />residents, as well as motorists using Oneka Lake Boulevard. <br />5. The applicant has not submitted building plans demonstrating that the twinhomes <br />could be constructed in conformance with applicable City regulations. <br />ADOPTED by the City Council this 5th day of August 2002. <br />
