RESOLUTION 200243 <br />APPROVING A FINAL PLAT AND DEVELOPMENT AGREEMENT FOR KETTLER <br />CONSTRUCTION FOR FENWAY PLACE ON PROPERTY NORTHWEST <br />QUADRANT OF 140TH STREET AND FENWAY BOULEVARD. <br />WHEREAS, Kettler Construction has requested approval of a final plat to allow <br />construction of 34 townhome lots, two common lots and two outlots on property legally <br />described as follows: <br />The following described tract of land lying in the north half of the <br />northeast quarter, Section 19, Township 31, Range 21, west of the fourth <br />principal meridian according to the government survey thereof, <br />Washington County, Minnesota: <br />Part of the southeast quarter of the southeast quarter of Section 19, <br />Township 31, Range 21, being the north 310 feet of the south 670 feet of <br />the west 687.58 feet of the east 787.58 feet. <br />Part of the southeast quarter of the southeast quarter of Section 19, <br />Township 31, Range 21, being the south 515 feet except the north 155 feet <br />of the east 787.58 feet and except the east 50 feet of the north 327 feet of <br />the south 360 feet thereof. <br />WHEREAS, the City has prepared a development agreement covering the improvements <br />related to said plat; <br />NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF <br />THE CITY OF HUGO, MINNESOTA, that it should and hereby does approve the final <br />plat for Kettler Construction for Fenway Place; and <br />FURTHER, that the development agreement for said plat be approved, and that the <br />Mayor and City Administrator be authorized to execute the development agreement on <br />behalf of the City; and, <br />FURTHER, that the following conditions be met prior to recording the final plat: <br />1. A final plat is approved to allow the creation of 34 townhome lots, two common lots <br />and two outlots, in accordance with the plans received by the City on July 19, 2002 <br />and revisions received on August 12, 2002, except as amended by this resolution. <br />2. The development agreement must be executed by the developer and the City prior to <br />release of the final plat for filing. <br />3. Development standards shall be according to the PUD general plan and preliminary <br />plat approvals granted by the City Council on July 1, 2002. <br />
