RESOLUTION 200243 APPROVING A FINAL PLAT AND DEVELOPMENT AGREEMENT FOR KETTLER CONSTRUCTION FOR FENWAY PLACE ON PROPERTY NORTHWEST QUADRANT OF 140TH STREET AND FENWAY BOULEVARD. WHEREAS, Kettler Construction has requested approval of a final plat to allow construction of 34 townhome lots, two common lots and two outlots on property legally described as follows: The following described tract of land lying in the north half of the northeast quarter, Section 19, Township 31, Range 21, west of the fourth principal meridian according to the government survey thereof, Washington County, Minnesota: Part of the southeast quarter of the southeast quarter of Section 19, Township 31, Range 21, being the north 310 feet of the south 670 feet of the west 687.58 feet of the east 787.58 feet. Part of the southeast quarter of the southeast quarter of Section 19, Township 31, Range 21, being the south 515 feet except the north 155 feet of the east 787.58 feet and except the east 50 feet of the north 327 feet of the south 360 feet thereof. WHEREAS, the City has prepared a development agreement covering the improvements related to said plat; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF HUGO, MINNESOTA, that it should and hereby does approve the final plat for Kettler Construction for Fenway Place; and FURTHER, that the development agreement for said plat be approved, and that the Mayor and City Administrator be authorized to execute the development agreement on behalf of the City; and, FURTHER, that the following conditions be met prior to recording the final plat: 1. A final plat is approved to allow the creation of 34 townhome lots, two common lots and two outlots, in accordance with the plans received by the City on July 19, 2002 and revisions received on August 12, 2002, except as amended by this resolution. 2. The development agreement must be executed by the developer and the City prior to release of the final plat for filing. 3. Development standards shall be according to the PUD general plan and preliminary plat approvals granted by the City Council on July 1, 2002.
