RESOLUTION 2001— 70 <br />A RESOLUTION BY THE CITY COUNCIL OF THE CITY OF HUGO, <br />WASHINGTON COUNTY, MINNESOTA, AUTHORIZING THE CITY STAFF <br />TO SEEK AND SECURE STATE TRANSPORTATION FUNDS FOR REMOVING <br />OBSTRUCTIONS IN WASHINGTON COUNTY JD2 <br />WHEREAS, the Rice Creek Watershed District (RCWD) determined Washington County <br />Judicial Ditch 2 (JD2) has been obstructed by culverts of insufficient hydraulic capacity installed by <br />the City of Hugo at 157'h Street and 165' Street; and <br />WHEREAS, the RCWD notified the City of Hugo of its responsibility to remove obstructions <br />caused by the inadequate culverts at 157* Street and 165h Street as soon as possible to maintain the <br />efficiency of Washington County JD2; and <br />WHEREAS, the City of Hugo must restore the crossings at 157" Street and 165a` Street as <br />nearly as practicable to the same condition as originally constructed and subsequently improved, <br />including resloping of Washington County JD2 and leveling of waste banks, if necessary, to prevent <br />further deterioration; and <br />WHEREAS, sufficient local funds to restore the crossings of Washington County JD2 to their <br />as -built condition and to maintain the intended capacity and efficiency are not and will not be <br />available so that funding assistance from State Transportation Bonds is necessary and desirable for <br />the City to proceed with the restoration; <br />NOW, THEREFORE, BE IT MUTUALLY AGREED AND RESOLVED, that the City Council <br />of the City of Hugo, Washington County, Minnesota, intends to remove the obstructions as soon as <br />possible when State Transportation Bond funds are available, and hereby authorizes its staff to seek <br />and secure such funds. <br />WHEREUPON, vote being taken upon the motion, the following members voted in favor: <br />Mike Granger, Chuck Haas, Becky Petryk, Frank Puleo, and Fran Miron <br />the following voted against: NONE <br />Whereupon said resolution was declared passed and adopted this 3day of December, 2001. <br />Aft'rMildn, Mayor <br />ATTEST: <br />X-Xw <br />&4� <br />Mary& Creager, City C <br />
