A <br />RESOLUTION 2000-10 <br />A RESOLUTION VACATING STREET EASEMENTS LOCATED <br />ALONG ELMCREST AVENUE <br />WHEREAS, the City of Hugo has been petitioned by the developers of the major subdivision <br />of Wenzel Farms to vacate certain street easements located within the parameters of that plat; <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />HUGO, WASHINGTON COUNTY, MINNESOTA AS FOLLOWS: <br />That all of the street easements described below are hereby vacated: <br />1. That part of Ehncrest Avenue North, Hugo, MN., as presently located and traveled in Section 19, <br />T31 N, R21 W, Washington County, MN., lying northerly of the center line of the easement <br />CSAH No. 8, as described in Book 291 of Deeds, page 356, said Washington County; and <br />2. That part of Elmcrest Avenue North, Hugo, MN., as presently located and traveled in Section <br />19, T3IN, R21 W, Washington County, MN., lying southerly of the center line of the <br />easement CSAH No. 8, as described in Book 291 of Deeds, page 356, said Washington <br />County; and <br />3. That the City Administrator shall prepare a Notice of Completion of these proceedings that <br />shall contain the name of the City, the identification of the vacation, a statement of the time of <br />completion thereof, and a description of real estate and land affected thereby. Such notice <br />shall be presented to the County Auditor/Treasurer who shall enter the same in his/her transfer <br />records and note upon the instrument over his/her official signature the words, "Entered in the <br />transfer records." The Notice shall then be filed with the County Recorder, all as required <br />pursuant to Minnesota Statutes, Section 412.851. <br />Approval of said RESOLUTION 2000-10 is contingent on the following being addressed: <br />1. A similar action must be taken by the City of Lino Lakes vacating the areas of Elmcrest <br />Avenue opposite those vacated by the City of Hugo. <br />2. Washington County must agree to the relocation of the intersection of Elmcrest Avenue and <br />CR8. <br />3. Platting and construction of the new Elmcrest Avenue must occur before the vacation is filed <br />with Washington County. <br />4. The respective Parks Departments from the City of Hugo and Lino Lakes must agree on a trail <br />alignment and easement as part of platting or vacation proceedings. <br />Upon roll call, the following members voting AYE: Barnes, Haas, Leroux, Petryk, Stoltzman <br />Voting NAY: NONE <br />Whereupon said resolution was declared passed and adopted this 1" day of May, 2000. <br />ATTEST: <br />&4ad,l XX -S -C, <br />Mary Creager, City Cler <br />Walter L.
