CITY OF HUGO <br />RESOLUTION 2000 - 42 <br />APPROVING FINDINGS OF FACT FOR REZONING OF PROPERTY LOCATED AT <br />12010 KEYSTONE AVENUE (20003) <br />WHEREAS, the City of Hugo initiated a reclassification of the zoning from Rural Residential <br />to Residential Service for approximately 0.6 acres of land located at 12010 Keystone Avenue, <br />legally described as follows: <br />That part of the SE1/4 of the SEI/4 of Section 36, T31N, R21W. <br />WHEREAS, the Planning Commission has reviewed said request at a duly called Public <br />Hearing and recommends approval; and <br />WHEREAS, the City Council has adopted an ordinance rezoning the affected parcel from <br />Rural Residential to Residential Service. <br />NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE <br />CITY OF HUGO, MINNESOTA, that it should and hereby does approve the request for <br />reclassification of the zoning from Rural Residential to Residential Service for approximately <br />0.6 acres of land locatedat 12010 Keystone Avenue, based on the following findings: <br />1. The rezoning changes the zoning of the property back to commercial in order to correct an <br />administrative error that occurred during the comprehensive update to the City's zoning <br />regulations in June of 1999. <br />2. The rezoning is consistent with the purpose and intent of the Residential Service zoning <br />district, which is to provide a location for commercial and service businesses to conveniently <br />serve the needs of a neighborhood. The existing bar and restaurant provide a commercial <br />service to this rural area of Hugo, and May and Grant Townships. <br />3. The proposed zoning classification is appropriate for the property given the topographic, <br />environmental, and cultural limitation of the site. The property owners have made substantial <br />improvements to the property, including installation of a new "mound" septic system in 1994. <br />4. Existing public infrastructure is adequate to handle the development that can reasonably be <br />foreseen on the site. The subject property receives access from Keystone Avenue (Co. Rd. <br />9), which is a paved roadway. Water and sanitary sewer is provided from an existing well <br />and septic system. <br />S. The proposed rezoning would not affect the boundaries of the MUSA. <br />
