RESOLUTION 200049 <br />A RESOLUTION VACATING PREVIOUS ACTIONS AND RESOLUTIONS <br />RELATED TO THE 129TH STREET PUBLIC IMPROVEMENT PROJECT AND <br />REFUNDING ANY MONEYS RELATED TO THE PROJECT THAT WERE PAID BY <br />PROPERTY OWNERS WITH INTEREST AS DETERMINED BY THE CITY <br />FINANCE DIRECTOR <br />WHEREAS, the City of Hugo, received a petition of affected property owners to <br />provide local sewer and water service; and, <br />WHEREAS, the City of Hugo, in response to the petition, ordered a feasibility report <br />for public improvements; and, <br />WHEREAS, the City of Hugo, approved Resolution 1999-2 adopting the assessment <br />roll for the 129` Street Public Improvement Project; and, <br />WHEREAS, the City of Hy, approved Resolution 1999-6 ordering improvement and <br />plans and specifications for the 129 Street Public Improvement Project; and, <br />WHEREAS, the City of Hugo, approved Resolution 1999-18 modifying the assessment <br />collection structure for the 129' Street Public Improvement Project; and, <br />WHEREAS, over 20 months has passed since the adoption of Resolution 1999-6 <br />ordering improvement and plans and specifications for the 129' Street Public Improvement <br />Project; and,- <br />WHEREAS, <br />nd, <br />WHEREAS, plans and specifications have not been completed for the project; and, <br />WHEREAS, contractors bids have not been solicited for the project; and, <br />WHEREAS, construction has not proceeded for the project; and, <br />WHEREAS, some of the assessments have been paid by property owners. <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />HUGO, WASHINGTON COUNTY, MINNESOTA, that the following occur: <br />1. Resolution 1999-2 adopting the assessment roll for the 129' Street Public Improvement <br />Project be vacated. <br />2. Resolution 1999-6 ordering the improvement and plans and specifications for the 129` <br />Street Public Improvement Project be vacated. <br />3. Resolution 1999-18 modifying the assessment collection structure for the 129` Street <br />Public Improvement Project be vacated. <br />4. The City's Finance Director shall refund any assessments paid to the City of Hugo by <br />property owners, or on behalf of property owners, listed on the Assessment Roll <br />attached to Resolution 1999-2 plus applicable interest as determined by the Finance <br />Director. <br />
