<br />RESOLUTION DECLARING COST TO BE ASSESSED, APPROVING THE PROPOSED
<br />ASSESSMENT ROLL, AND ORDERING A HEARING ON THE PROPOSED ASSESSMENT
<br />FOR THE OAKSHORE PARK PUBLIC IMPROVEMENT PROJECT
<br />WHEREAS, on November 6, 1995, the Council received a petition from property owners in the
<br />Oakshore Park subdivision for the extension of municipal water and sanitary sewer mains,-
<br />reconstruction
<br />ains;reconstruction of streets, curb and gutter, and stomp sewer, pursuant to Minnesota Statutes,
<br />Section 429.011 to 429.111 to the real property abutting the following streets: Ethan Avenue
<br />from 126th Street to the south line of N 1/2 of Section 31, T31, R21 W; Everton Avenue from
<br />126th Street to the south line of the Oakshore Park Subdivision; Europa Avenue from 126th
<br />Street to the south line of the Oakshore Park Subdivision; 125th Street from Exhall Avenue to
<br />the west line of Ethan Avenue; 126th Street Court from 126th Street to the end of the cube -sac;
<br />and Exhall-Avenue from the north line of -the Oakshore-P-ark.to 126th -Street; -and
<br />ordered the City Engineer to prepare a feasibility report for the making of such improvements;
<br />and
<br />WHEREAS, the Council conducted a public improvement healing on the proposed project on
<br />January 8, 1996, which was continued on February•20,1996 and April 1,1996; and
<br />WHEREAS, the Council received a written report from the firm of Dahlen S Dwyer, Inc., dated
<br />March 1, 1996, on the special benefits property owners would obtain from the proposed
<br />improvements; and
<br />WHEREAS, the Council, on April 1, 1996, tabled action on the proposed subdivision until such
<br />time as the public improvements foreseen as part of the Woods of Bald Eagle Subdivision were
<br />finalized through a signed Development Agreement and posting of necessary escrow, as the cost
<br />estimates for the Oakshore Park improvements were based on the Woods of Bald Eagle
<br />development occurring first; and
<br />WHEREAS, following the construction of improvements as part of the Woods of Bald Eagle
<br />subdivision, the Council ordered the improvement process to begin anew and directed the City
<br />Engineer to update project cost estimates for the Oakshore Park Improvements on August 3,
<br />1998; and
<br />WHEREAS, the Council conducted a public hearing on the proposed project on September 8,
<br />1998, which was continued on October 5,1998; and
<br />WHEREAS, the Council has received a project cost estimate from the City Engineer, dated
<br />October 18, 1998, and a proposed assessment roll prepared by the City Administrator dated
<br />August 31; 1998;
<br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF HUGO, MINNESOTA:
<br />1. The cost of proposed improvements to be paid by the City is estimated to be $523,180, and
<br />the portion of the cost to be assessed against benefited property owners is declared to be
<br />$738,820.
<br />2. Assessments shall be payable in -equal annual installments extending over a period of fifteen
<br />(15) years, the first of the installments to be payable on or before the first Monday in January,
<br />2000, and shall bear interest at the rate of eight percent (8) per annum from the date of adoption
<br />of the assessment resolution.
<br />3. A hearing shall be held on the 16th day of November in the City Hall at 7.05 p.m. to pass
<br />upon the proposed assessment, and at such time and place, all persons owning property affected
