RESOLUTION 1996-11 <br />A RESOLUTION APPROVING THE DISSOLUTION OF THE <br />BROWN'S CREEK WATERSHED MANAGEMENT <br />ORGANIZATION <br />WHEREAS, the City of Hugo is a member community of a joint powers <br />organization known as the Brown's Creek Watershed Management Organization. <br />WHEREAS, the City of Hugo is aware that efforts by the Brown's Creek <br />WMO to update its Joint Powers Agreement have failed. <br />WHEREAS, the City of Hugo is aware that the Minnesota Board of Soil <br />and Water Resources has declared that The Brown's Creek WMO has failed to <br />implement its plan through failure to update its Joint Powers Agreement to provide <br />the powers to do so. <br />WHEREAS, the Brown's Creek WMO Board of Commissioners voted on <br />August 21, 1996, to recommend that the member communities unanimously agree <br />to dissolve the current Brown's Creek WMO Joint Powers Agreement pursuant to <br />Section 8.2 of the Agreement. <br />NOW, THEREFORE, based on the foregoing, the following resolution was duly <br />made, seconded, and approved: <br />1. The City Council of the City of Hugo supports the recommendation of the <br />Brown's Creek WMO Commissioners that the Joint Powers Agreement be <br />dissolved. <br />2. The City of Hugo agrees with the findings of the Board of Water and Soil <br />Resources that the Brown's Creek WMO has failed to implement its plan. <br />3. The City of Hugo hereby approves the dissolution of the Joint Powers <br />Agreement forming the Brown's Creek Watershed Management Organization - <br />Voting AYE: Agness, Barnes, Goiffon, Moon <br />Voting NAY: NONE <br />Where upon said resolution was declared passed and adopted this 21st day of <br />October, 1996. <br />Prg'Won, Mayor <br />ATTEST: <br />MaryCreager, City Cl <br />
