P <br />835269 <br />CITY OF HUGO <br />WASHINGTON COUNTY,MINNESOTA <br />RESOLUTION NO. 1995- '- <br />A <br />A RESOLUTION VACATING A PUBLIC UTILITY EASEMENT IN EXCHANGE FOR <br />OBTAINING A NEW PUBLIC UTILITY EASEMENT IN THE SAME PRACTICAL <br />LOCATION. <br />WHEREAS, the above -entitled matter came on for a public <br />hearing before the City Council of the City of Hugo, Washington <br />County, Minnesota, on the 6th day of February 1995; <br />and, <br />WHEREAS, following a public hearing regarding this issue, <br />the City Council hereby determines that it is in the best interests <br />of the City of Hugo to vacate a portion of the existing public <br />utility easement located across property which is located at 5725 <br />148th Street North, City of Hugo, Washington County, Minnesota, in <br />exchange for another public utility easement which is located in a <br />more practical place. <br />NOW, THEREFORE, based upon a motion duly second and <br />approved, the City Council hereby directs as follows: <br />1. The existing public utility easement legally <br />described as follows: <br />Document Number 324256: <br />A permanent utility easement 20 feet in width and having <br />northerly and southerly boundaries parallel to the North <br />right-of-way line of 147th Street N. and lying within the <br />Northeast Quarter (NEU) of the Northwest Quarter (NW's), <br />Section 20, Township 31 North, Range 21 West, Washington <br />County, Minnesota, the centerline of which is described <br />as follows: <br />Beginning at a point, said point being 135 feet <br />(more or less) north of the north right-of-way line <br />of 147th Street N. and 173 feet east of the <br />easterly right-of-way line of Forest Boulevard <br />(U.S. Highway 61) on a line parallel to said North <br />right-of-way line of 147th Street N., said <br />centerline extending parallel to said easterly <br />right-of-way line of Forest Blvd., a distance of <br />138 feet (more or less) and there terminating, <br />subject to easements of record; <br />(Comprising 0.06 acres more or less) <br />is hereby vacated. <br />
