<br />RESOLUTION ENDORSING FORMATION OF A BROWN'S
<br />CREEK WATERSHED DISTRICT
<br />WHEREAS, the portion of the City of Hugo lying within the boundaries of
<br />the Brown's Creek watershed has been subject to flooding in 1986, and
<br />again in 1995, and
<br />WHEREAS, such flooding has posed a threat to the public health, safety,
<br />and welfare by inundating septic systems, threatening damage to human
<br />habitation, and blocking public roads, and
<br />WHEREAS, it is necessary to establish a management plan for, and construct
<br />improvements to. the Brown's Creek watershed in order to alleviate current
<br />flooding, protect against future flooding, protect public and private
<br />investment, and provide stewardship for the natural environment, and
<br />WHEREAS, the preparation of such a plan, construction of necessary
<br />improvements, and management of the watershed is best performed by a
<br />public body with the necessary authority and jurisdiction to coordinate,
<br />conduct and implement the plans, improvements and management activities,
<br />and,
<br />WHEREAS, Minnesota Statutes, Section 103D.101, grants the authority to
<br />establish watershed districts to the Board of Water and Soil Resources
<br />after the filing of an establishment petition, and
<br />WHEREAS, Minnesota Statutes, Section 103D.205, Subdivision 3 allows a
<br />County having 50 percent or more of the area within the proposed watershed
<br />district to file such a petition with the Board of Water and Soil
<br />Resources, and
<br />WHEREAS, the Brown's Creek watershed lies entirely within the boundaries
<br />of Washington County, Minnesota,
<br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF HUGO,
<br />WASHINGTON COUNTY, MINNESOTA, that it requests the Washington County Board
<br />of Commissioners file a petition with the Board of Water and Soil
<br />Resources to establish a watershed district within the boundaries of the
<br />Brown's Creek Watershed Management Organization for the purpose of
<br />conserving natural resources, alleviating damage from flood waters, and
<br />protecting the public's health, safety, and welfare.
<br />Upon roll call, the following voting AYE: Barnes, Goiffon, LaValle,
<br />Lerouxp Miron
<br />Voting NAY: NONE
<br />Whereupon said resolution was declared passed and adopted this 18th day of
<br />September. 1995.
