RESOLUTION 95-18 <br />RESOLUTION DECLARING ADEQUACY OF PETITION <br />AND ORDERING PREPARATION OF FEASIBILITY REPORT <br />(OAKSHORE PARK) <br />BE IT RESOLVED BY THE CITY COUNCIL OF NUSQ, MINNESOTA: <br />1. A certain petition requesting the improvement by the extension of <br />municipal water maims, water service lines, sanitary sewer mains, sanitary <br />sewer service lines, reconstruction of streets, curb and gutter, and storm <br />sewer for real property abutting on the west side of Exhall Avenue Worth, <br />from the north line of Qakshore Park Subdivision to the intersection with <br />126th Street North, on 126th Street North, from the intersection with <br />Exhell Avenue North, west to the intersection with Ethan Avenue North, on <br />126th Street Court North, from the intersection with 126th Street North, <br />south to the southern point of the cul-de-sac, and on Ethan Avenue North, <br />from the north line of {]akshore Park Subdivision south to the south line <br />of 0akshore Park Subdivision, is hereby declared to be signed by the <br />required percentage of owners of property affected thereby. This <br />declaration is made in conformity to Minnesota Statutes, Section 429.035. <br />2. FURTHERMORE, due to a mistake in the property description in the <br />petition, the City Engineer is to add to the feasibility report Europa <br />Avenue, from 126th Street to the south line of the Qakshore Park <br />subdivision, in order to include the entire subdivision in the project. <br />3. FURTHERMORE, due to concerns in creating a safe street alignment on <br />the curves of Ethan Avenue, 122nd Street and Everton Avenue, the City <br />Engineer is to provide, as a separate item, the feasibility of <br />constructing the improvement proposed for Ethan Avenue, south to the <br />intersection of 122nd Street and Everton Avenue. <br />4. The petition is hereby referred to the City Engineer, Thomas Angus, <br />and he is instructed to report to the Council with all convenient speed <br />advising the Council in a preliminary way as to whether the proposed <br />improvement is feasible. The Engineer shall recommend whether the project <br />should best be made as proposed or in connection with some other <br />improvement, and the estimated cost of the improvement, as recommended. <br />Upon roll call, following members voting AYE: Debra Barnes, Andrew <br />Goiffon, Marvin LaVal%ev James Leroux, Fran Miron <br />Voting NAY: NONE <br />Whereupon said resolution was declared passed and adopted this 6th day of <br />November, 1995. <br />
