RESOLUTION 94-17 <br />A RESOLUTION APPROVING A JOINT POWERS AGREEMENT <br />BETWEEN THE CITY OF HUGO AND THE DAKOTA COUNTY <br />CONSORTIUM FOR THE PROCUREMENT AND MANAGEMENT <br />OF LOW INCOME HOUSING FUNDS. <br />WHEREAS, The Cranston -Gonzales National Affordable Housing Act of 1990 <br />(the "Act") permits geographically contiguous units of general local <br />government to form consortia for the purpose of applying for and <br />receiving funding to assist in carrying out a Comprehensive Housing <br />Affordability Strategy under the act; and <br />WHEREAS, the HOME program, as authorized by Title II of the Act, <br />provides for Tenant Based Rental Assistance, Homeownership <br />Rehabilitation, New Construction, Rental Rehabilitation and Homebuyer <br />Assistance to low income members of the community; and <br />WHEREAS, Minnesota Statutes, Section 471.59 provides that two or more <br />governmental units, by agreement entered into through action of their <br />governing bodies, may jointly or cooperatively exercise any powers <br />common to the contracting parties or any similar powers; and <br />WHEREAS, The Washington County Board of Commissioners has entered into <br />a Joint Powers Agreement with Anoka County Dakota County, and Ramsey <br />County, known as the Dakota County Consortium, to administer the <br />Federal HOME program under the Act; and <br />WHEREAS, The Washington County Housing and Redevelopment Authority has <br />informed the City of Hugo that in order to use HOME funds within the <br />City of Hugo, the City must enter into the Dakota County Consortium <br />through the Joint Powers Agreement; and <br />WHEREAS, The Washington County Housing and Redevelopment Authority has <br />also stated that the City shall not incur any financial or other <br />responsibility for the Dakota County Consortium nor be held liable by <br />the Consortium for any fees, charges, contributions, or other financial <br />assistance except as approved by specific, separate action of the Hugo <br />City Council; and <br />WHEREAS, the provision of the services and assistance available from <br />the HOME program will benefit members of the community, and serve to <br />further the worthwhile goals of homeownership and affordable housing; <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF HUGO, <br />WASHINGTON COUNTY, MINNESOTA: <br />1. The Mayor and City Clerk are herby authorized and directed to <br />enter into the JOINT POWERS CONSORTIUM AGREEMENT with the Dakota County <br />Consortium on behalf of the City of Hugo. <br />
