RESOLUTION 94-17 A RESOLUTION APPROVING A JOINT POWERS AGREEMENT BETWEEN THE CITY OF HUGO AND THE DAKOTA COUNTY CONSORTIUM FOR THE PROCUREMENT AND MANAGEMENT OF LOW INCOME HOUSING FUNDS. WHEREAS, The Cranston -Gonzales National Affordable Housing Act of 1990 (the "Act") permits geographically contiguous units of general local government to form consortia for the purpose of applying for and receiving funding to assist in carrying out a Comprehensive Housing Affordability Strategy under the act; and WHEREAS, the HOME program, as authorized by Title II of the Act, provides for Tenant Based Rental Assistance, Homeownership Rehabilitation, New Construction, Rental Rehabilitation and Homebuyer Assistance to low income members of the community; and WHEREAS, Minnesota Statutes, Section 471.59 provides that two or more governmental units, by agreement entered into through action of their governing bodies, may jointly or cooperatively exercise any powers common to the contracting parties or any similar powers; and WHEREAS, The Washington County Board of Commissioners has entered into a Joint Powers Agreement with Anoka County Dakota County, and Ramsey County, known as the Dakota County Consortium, to administer the Federal HOME program under the Act; and WHEREAS, The Washington County Housing and Redevelopment Authority has informed the City of Hugo that in order to use HOME funds within the City of Hugo, the City must enter into the Dakota County Consortium through the Joint Powers Agreement; and WHEREAS, The Washington County Housing and Redevelopment Authority has also stated that the City shall not incur any financial or other responsibility for the Dakota County Consortium nor be held liable by the Consortium for any fees, charges, contributions, or other financial assistance except as approved by specific, separate action of the Hugo City Council; and WHEREAS, the provision of the services and assistance available from the HOME program will benefit members of the community, and serve to further the worthwhile goals of homeownership and affordable housing; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF HUGO, WASHINGTON COUNTY, MINNESOTA: 1. The Mayor and City Clerk are herby authorized and directed to enter into the JOINT POWERS CONSORTIUM AGREEMENT with the Dakota County Consortium on behalf of the City of Hugo.
