<br />RESOLUTION FOR NOTIFICATION OF AFFECTED LANDOWNERS AND SETTING
<br />PUBLIC HEARING FOR VACATION OF A ROAD RIGHT-OF-WAY WITHIN THE
<br />CITY OF HUGO
<br />WHEREAS, the City of Hugo, Washington County, Minnesota, hereinafter the
<br />"City", was made a party to litigation initiated by Joseph B. Stanek and
<br />Marilyn D. Stanek, husband and wife, identified as Court File No.
<br />C190-2.482 in Washington County Court, and
<br />WHEREAS, the litigation in part involved a dispute of to rights in a
<br />public right-of-way established on or about June 10, iegg, being four (4)
<br />rods wide, with the centerline described as follows:
<br />Beginning at the corner post at the NW corner of the SW 1/4 of Section 12,
<br />T31N, R21W, and running North on the Section line between Sections 11 and
<br />12,, and I and 2 as near as practicable 1-1/2 miles more or less to the
<br />N.W. corner of Section One (1) and intersecting with the Town Line Road
<br />between the Towns of Oneka and Forest Lake and there terminating,
<br />WHEREAS, some of the named parties in said litigation have entered into a
<br />Settlement Agreement and Release, said parties being Joseph B. Stanek,
<br />Marilyn D. Stanek, Thomas Pogreba, Sharon Pogreba, Steven Erickson,
<br />Carolyn Erickson, Northern States Power, and the City of Hugo, and
<br />WHEREAS, said Settlement Agreement includes an undertaking of the City to
<br />initiate a street vacation proceeding for a portion of the disputed
<br />right-of-way;
<br />NOW THEREFORE BE IT RESOLVED, That the City Council of the City of Hugo
<br />hereby initiates a street vacation proceeding pursuant to the provisions
<br />of Minnesota Statutes Annotated, Section 412.851, to vacate a portion of
<br />the right-of-way described herein, said portion described as the disputed
<br />right-of-way between Sections I and 2 to the North of the Stanek property.
<br />BE IT FURTHER RESOLVED, That a Public Hearing be set for 7:00 PM, on the
<br />18th day of February,, 1992, to be held in the Council Chambers, Hugo City
<br />Hall, 5524 Upper 146th Street, Hugo, MN, to hear public input regarding
<br />the proposed vacation.
<br />BE IT FURTHER RESOLVED, That Notice of the Public Hearing be published and
<br />posted not less than two weeks prior to the date for the Public Hearing.
<br />BE IT FURTHER RESOLVED, That a copy of this Resolution, and the proposed
<br />Resolution vacating the portion of the disputed right-of-way, be mailed to
<br />each property owner affected by the proposed vacation not less than ten*
<br />(10) days prior to the date of the Public Hearing.
<br />Upon roll call, members voting AYE: Barnes, Brunotte, Jesinski, Miron,
<br />Stoltzman
<br />Voting NAY: NONE
<br />Whereupon said Resolution was declared passed and adopted this 21st day of
<br />January, 1992.
