N'44 <br />Ll ' 16TI 1 # Rh <br />RESOLUTION 1992-3 <br />RESOLUTION VACATING ROAD RIGHT-OF-WAY PURSUANT <br />TO SETTLEMENT AGREEMENT AND RELEASE. <br />WHEREAS, The City of Hugo, Washington County, Minnesota, has entered <br />into a Settlement Agreement and release, by and between Joseph B. Stanek, <br />Marilyn D. Stanek, Steven and Carol Erickson, Thomas and Sharon Pogreba.. <br />and Northern States Power Company of Minnesota, for the purpose of <br />settling the matter of the existence, location, and permissible use of an <br />alleged public road right-of-way located in the City of Hugo, and <br />WHEREAS, The settlement defendants, and Stanek's. have entered into an <br />Agreement providing alternate access to the Stanek's property by way of a <br />private road easement to assure that said property is not landlocked, and <br />WHEREAS, the City Council has deemed it expedient that the matter of <br />this road right-of-way vacation be filed with its City Clerk, and that a <br />hearing thereon be scheduled in the Council chambers of the Hugo City Hall <br />on February 18, 1992 at 7:00PM, and that the City Clerk did give notice of <br />hearing, as provided by Minnesota Statutes, and <br />WHEREAS*. the City Council beingsatisfiedthat due notice of said <br />hearing -.has been *given as provided by law, and after due investigation and <br />consideration of the Settlement Agreement and the testimony adduced in <br />support thereof, there being no appearance and opposition thereto, and <br />being satisfied that said vacation should be granted; <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF HUGOV <br />WASHINGTON COUNTY, MINNESOTA: That the following described road r ** ight-of- <br />way be, and hereby is., vacated and is discontinued to wit: A strip of <br />land four rods wide (66') the center line of which is described as <br />follows; Beginning at the corner post at the northwest corner of Section <br />1,, Township 31 North, Range 21 West, and running southerly between <br />Sections I and 2, a distance of 1400 ft.
