RESOLUTION 1991-12 <br />RESOLUTION APPOINTING ACTING CITY PROSECUTOR <br />TO HANDLE THE CIVIL PROSECUTION OF CAROL AND <br />DAVID SCHUMANN FOR ALLEGED ORDINANCE VIOLATIONS <br />WHEREAS, the Hugo City Council directed the civil prosecution of <br />David and Carol Schumann, for alleged ordinance violations, on September <br />4, 1990, and <br />WHEREAS, pursuant to Resolution 1998-44, the City Council has <br />directed its insurance company and/or City Attorney to defend the City, <br />and file counter claims to recover expenses with regard to the lawsuits <br />filed by Carol and David Schumann against the City of Hugo, and <br />WHEREAS, the City Council at its August 5, 1991 regular meeting, <br />acted to drop Mr. Richard Hocking as the City's prosecutor in its civil <br />litigation against Carol and David Schumann because his being sued by the <br />Schumanns may jeopardize the City's case, and <br />WHEREAS, the City Council has directed the City Attorney, Charles <br />Johnson, to provide the City Council with a list of names to replace Mr. <br />Richard Hocking as acting City Prosecutor in this matter, <br />NOW. THEREFORE, BE IT RESOLVED THAT THE CITY COUNCIL OF THE CITY OF HUGO, <br />WASHINGTON COUNTY, MINNESOTA: <br />That said Council hereby appoints Mr. Jeff Carson as legal counsel from <br />the law firm of Carson & Clelland to pursue the civil prosecution of Carol <br />and David Schumann, and <br />BE IT FURTHER RESOLVED, that said legal counsel shall pursue remedies and <br />damages, including seeking recovery of attorney's fees, and all other <br />expenses and damages to the extent allowable by law, pursuant to <br />Resolution 1990-44 of the City Council. <br />Upon roll call, the following members voting AYE: Brunotte, Jesinski, <br />McAllister, Miron, Stoltzman <br />Voting NAY: NONE <br />Whereupon said resolution was declared passed and adopted this 12th day of <br />August, 1991. <br />Walter L.
