RESOLUTION 1987-41 <br />RESOLUTION AUTHORIZING THE CITY ADMINISTRATOR TO FILE AN APPEAL OF THE <br />1988 LEVY LIMIT AS IT AFFECTS THE CITY OF HUGO <br />WHEREAS, recent state legislation restricts small cities under population <br />of 5,000 with a three percent (3%) tax levy limit, and <br />WHEREAS, the City ofHugo has not been subject to a levy limit in previous <br />years, and <br />WHEREAS, the city failed to collect budgeted homestead credit in 1984, <br />1985 and 1986 as a result of the tax levy error which affects the city's <br />tax levy base, and <br />WHEREAS, the city's tax levy base in turn affects the amount of local <br />government aid received by municipalities, and <br />WHEREAS, the legislature has frozen local government aids at the 1987 <br />fiscal year level, and <br />WHEREAS, the City of Hugo is required to prepare a local water management <br />plan pursuant to Minnesota Statutes 473.878 in 1988 for submittal in <br />1989 at an estimated cost of $70,000.00, and <br />WHEREAS, the Minnesota law restricting the tax levy limit to three percent <br />(3%) annually would affect compliance with Minnesota Statutes 473.878 <br />and other state mandates <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Hugo, <br />Washington County, Minnesota that the City Administrator be and hereby <br />is authorized to file an appeal from the three percent (3%) levy limit <br />with the Commissioner of Revenue within the spirit of the appeals <br />process as provided by the State Legislature. <br />ADOPTED AND PASSED THIS 20th DAY OF July , 1987. <br />eorg A ins , Mayor <br />'City/of'City/of Hugo <br />ATTEST: <br />Mary Creager, CitL/Trk_ <br />
