RESOLUTION 1985-22 <br />A RESOLUTION ADDRESSING PROPOSED <br />AMENDMENTS to MINN. RULES PARTS <br />7010.0100 - 7010.0700, STATE <br />NOISE STANDARDS <br />TO: MINNESOTA POLLUTION CONTROL AGENCY <br />MR THOMAS J KALITOWSKI <br />EXECUTIVE DIRECTOR <br />BE IT RESOLVED, BY the City Council of the City of Hugo, Minnesota, the <br />following: <br />WHEREAS, The City of Hugo is responding to the above mentioned rule <br />changes as found in the Minnesota State Register (9 S.R. 2058, March 18 <br />1985). Titled draft rule amendments. <br />WHEREAS, The City of Hugo is responding in particular to page 2060. <br />Item 7010.0040 NOISE STANDARDS. Subpart 1. "Scope" Where -in it is stated; <br />" NOISE STANDARDS IN SUBPART 2 APPLY TO ALL SOURCES" <br />AND <br />Item 7010.0050 NOISE AREA CLASSIFICATION. Subpart 2. NOISE AREA <br />CLASSIFICATIONS. under; <br />NOISE AREA <br />CLASSIFICATION LAND USE ACTIVITIES <br />2 Commercial, entertainment, and RECREATIONAL; includes <br />office buildings, retail stores and services, transient <br />lodging, medical facilities not providing nighttime <br />care, and athletic fields. <br />WHEREAS, The City of Hugo has with -in its Jurisdiction, skeet, trap <br />and/or shooting snorts clubs which produce impulsive noise. <br />WHEREAS, The Citizens of Hugo have on two occasions, been involved in <br />legal actions regarding impulsive noise. The above two actions culminated <br />in decisions being handed down by the Minnesota Supreme Court. <br />WHEREAS, The City of Hugo is itself presently involved in legal action <br />regarding impulsive noise. <br />WHEREAS, The City of Hugo obiects to any proposed rule changes affecting <br />Impulsive noise standards•. <br />WHEREAS, In summary the City of Hugo obiects to any rule changes which <br />may come into conflict with; <br />Minnesota Statute 116.07 Subdivision 2a <br />
