City Council meeting of July 18, 2005 <br />Page 6 <br />the intersection of 152nd Street and Keystone Avenue. Communication towers are allowed in the <br />Agricultural District with the approval of a Conditional Use Permit. The proposed tower does not meet <br />the required setbacks from a residential structure and from a property line; therefore, two variances are <br />requested. Based on information provided by the applicant, City staff is of the opinion that the <br />application does not comply with the City's Antenna Ordinance. In addition, the criteria that must be <br />satisfied in order to grant variances have not been met. Staff recommended denial of the application to <br />the Planning Commission on July 14, 2005. CD Director Bryan Bear provided a background of the <br />application, which was submitted in March 2005. The applicant has requested a 30 -day extension to <br />allow them additional time to provide requested information, and that extension was recommended for <br />approval by the Planning Commission. The Council had before them for consideration a resolution <br />approving findings of fact denying a variance for a property line setback; the application would have two <br />parts remaining: 1) variance for setback from a residence; and 2) approval of a CUP allowing <br />installation of the tower. City Attorney Dave Snyder stated that if Council granted the 30 -day extension, <br />the application would need to be addressed at its meeting of August 1, 2005, as the following regular <br />meeting (8/15/05) would be outside of the 30 -day extension timeframe. <br />Miron made motion, Haas seconded, to adopt RESOLUTION 2005-40 APPROVING FINDINGS OF <br />FACT DENYING A VARIANCE FOR CINGULAR WIRELESS FOR A PROPERTY LINE <br />SETBACK FOR A 190 -FOOT TOWER AT 15380 KEYSTONE AVENUE. <br />VOTING AYE: Granger, Haas, Petryk, Puleo, Miron <br />Motion Carried. <br />Miron made motion, Granger seconded, to approve the 30 -day extension requested by Debra Weis, <br />representing Cingular Wireless, extension commencing July 14, 2005, and schedule a public hearing for <br />August 1, 2005 to consider the balance of the application. Property owners within 1,000 ft of 15380 <br />Keystone Avenue will be notified of the public hearing. <br />All aye. Motion Carried. <br />TRUCK TRAFFIC ON CSAH 8 <br />City Administrator Mike Ericson received a verbal communication from a resident regarding the traffic <br />hazard being created by trucks on CSAH 8, as a result of construction activity. Council discussed <br />possible traffic signs that could be installed to prevent a safety problem. <br />Miron made motion, Granger seconded, directing staff to contact Washington County and develop traffic <br />control measures/signage on CSAH 8. <br />All aye. Motion Carried. <br />ADJOURNMENT <br />Puleo made motion, Granger seconded, to adjourn at 9:55 pm. <br />All aye. Motion Carried. <br />
