City Council meeting of July 16, 2001 <br />Page 6 <br />INVOICE FROM WASHINGTON COUNTY FOR COURT FEES FOR JD2 LAWSUIT <br />Mayor Miron turned the meeting over to acting Mayor Chuck Haas. Attorney Paul Haik presented for <br />Council related court fees that the City must pay for the JD2 lawsuit. As Council is aware, Judge <br />Stephen Muehlberg ruled for the defendants and charged the City with the responsibility of paying for <br />the Washington County court fees. Mr. Haik indicated that, as negotiated, the court fees are down from <br />the $30,000 claimed by the defendants to an amount of $6,026.30. <br />Granger made motion, Puleo seconded, to approve the payment of $6,026.30 for Washington County <br />court fees provided that the defendants sign a release stating that this is the final amount owed by the <br />City. <br />VOTING AYE: Granger, Haas, Petryk, Puleo <br />Motion Carried. <br />Acting Mayor Haas turned the meeting back over to Mayor Miron. <br />RESOLUTION APPROVING QUICK -TAKE CONDEMNATION OF EASEMENTS IN THE <br />PELOOUIN INDUSTRIAL PARK <br />City Attorney Dave Snyder prepared a formal resolution for consideration by the Council approving the <br />quick -take condemnation for the Peloquin Industrial Park P.I. Project. City staff recommended the <br />Council approve the resolution approving the quick -take condemnation with the understanding that staff <br />proceed with the finalization of the property easements for most of the property owners. <br />Haas made motion, Granger seconded, to adopt RESOLUTION 2001-34 APPROVING THE QUICK- <br />TAKE <br />UICKTAKE CONDEMNATION FOR THE PELOQUIN INDUSTRIAL PARK P.I. PROJECT. <br />Haas made motion, Granger seconded, to amend the previous motion that the resolution identifies the <br />value of the drainage easement to be vacated on the Glamos property. <br />VOTE ON AMENDMENT: Granger, Haas, Puleo, Miron <br />ABSTAINED: Petryk <br />Motion Carred. <br />VOTE ON ORIGINAL MOTION: Granger, Haas, Puleo, Miron <br />ABSTAINED: Petryk <br />Motion Carried. <br />REZONING & PRELIMINARY PLAT APPROVAL FOR PINEVIEW MEADOWS 2ND <br />ADDITION <br />At its June 27, 2001 meeting, the Planning Commission considered a rezoning and preliminary plat for <br />the Pineview Meadows 2"d Addition, and unanimously recommended approval. The plat would include <br />an additional 66 townhomes adjacent to Pineview Meadows 1" Addition. Staff recommended Council <br />approve the rezoning of the property from urban residential to multi -family and the preliminary plat for <br />
