MINUTES FOR THE CITY COUNCIL MEETING OF JULY 26.1999 <br />The Mayor convened a special meeting of the Hugo City Council at 7:00 pm. <br />PRESENT: Barnes, Haas, Leroux, Petryk, Stoltzman <br />City Administrator, Robert Museus <br />The special meeting was called to meet with Mr. Paul Haik, attorney representing the City in its lawsuit <br />with the RCWD over JD2, as well as to tour the City's new Fire Hall. <br />The City Administrator requested that the Council consider approving the transfer of the City's voting <br />equipment to Washington County so the County may trade in the existing equipment for new. The <br />County is to pick up any additional cost associated with acquiring new balloting equipment. <br />Barnes made motion, Haas seconded, to approve the transfer of the City's current balloting equipment <br />to Washington County. <br />All aye. Motion Carried. <br />The City Council then conducted a tour of the City's new Fire Hall. Council members Leroux and <br />Petryk joined the meeting at the Fire Hall. The Council was given a tour of the facility by Joe <br />McMahon, Fire Chief, Jim Compton, Asst. Chief, and Jim Trossen, project manager. <br />The Council returned to City Hall at 8:20 pm. <br />Stoltzman made motion, Haas seconded, to move the Council meeting into closed session for the <br />purpose of obtaining legal advice from Paul Haik regarding the City's litigation with the RCWD on <br />JD2. <br />All aye. Motion Carried. <br />At 9:20 pm, the Council returned to open session. Councilman Haas questioned Mr. Haik on the <br />standards to be applied in determining wetlands under the Wetlands Conservation Act; specifically, how <br />these conditions may apply to property owned by the City in the Bald Eagle Industrial Park. Mr. Haik <br />stated that three conditions needed to be present in order for the property to be considered wetlands: <br />1) there must be wetland vegetation on the site; 2) site must consist of hydric soils; and 3) the soil must <br />be saturated within 12" of the surface for a specific number of days during the year. If any one or more <br />of the conditions are not present, the property would not be considered wetlands. Mr. Haik stated the <br />Council may wish to consider working with a technical evaluation panel to install piezometer on the site <br />to determine if the three wetlands conditions are present. <br />Stoltzman made motion, Leroux seconded, to adjourn at 9:25 pm. <br />All aye.
