M I NUM FOR THR HUGO CITY CUUNC I L M" T t G QF MARCH 20, 9 <br />The meeting was called to order by Mayor Fran Miron at 7:05 PM. <br />PRESENT: Barnes. Goiffon, LaValle, Leroux,, Miron <br />City Attorney, Greg Galler <br />City Engineer, Joel Dresel <br />City Clerk, Mary Ann Creager <br />The following items were added to tonight's agenda for discussion: <br />condition of City roads, letter from Lee Johnson regarding black powder <br />testing at the DESA, and letter requesting reservation of City park. <br />Leroux made motion, LaValle seconded, to approve the minutes for the City <br />Council meeting of March 6, 1995, as amended. <br />VOTING AYE: Goiffon, LaValle, Leroux. Miron <br />ABSTAINED: Barnes <br />Motion Carried. <br />Leroux made motion, Goiffon seconded, to approve the claims for March 2c), <br />1995, in the amount of $24.813.37. <br />All aye. Motion Carried. <br />PUBLIC HEARING (ROCK CRUSHER ORDINANCE) <br />Attorney Galler explained the conflict existing in the City ordinance that <br />necessitates the need for the proposed ordinance. After discussions with <br />Dean Atkinson's attorney, Bruce Malkerson, Attorney Galler submitted the <br />language suggested by Mr. Malkerson, as well as his own suggested changes. <br />Councilmember Barnes felt it necessary that dust and noise should be <br />addressed to protest surrounding property owners. The public hearing was <br />opened and the following comments were made: Dave Schumann, no problem <br />with rock crushing, valuable resource: Dean Atkinson, requested that the <br />Council approve ordinance modification; and Ed Waller, conduct all mining <br />activities at one site to save City road. The public hearing was closed, <br />and the Council then discussed the hauling in of materials and the use of <br />existing materials on site. The Council did agree that the Atkinson <br />mining site should not be sold, at a later date, to another contractor for <br />use as a commercial site. Councilman LaValle stated, for the record, that <br />Mr. Atkinson has not hauled in any recycling materials to his property for <br />the last two years. <br />Goiffon made motion, Barnes seconded, to table this matter until the <br />meeting of April 3, 1995. <br />All aye. Motion Carried. <br />PUBLIC HEARING (PIPELINE SETBACK ORDINANCE) <br />The public hearing was called to order and there were no oral or written <br />comments. <br />Leroux made motion, Goiffon seconded, to adopt ORDINANCE 95-296, AN <br />ORDINANCE AMENDING CHAPTER 320 OF THE HUGO CITY CODE ENTITLED "ZONING" BY <br />ESTABLISHING BUILDING SETBACK REQUIREMENTS FROM CERTAIN PIPELINES. <br />A11'aye. Motion Carried. <br />
