Applicant stated that should he need another future expansion it would at that point <br />be time for him to relocate. <br />Staff has observed the property over the last several months and has not observed any excessive <br />noise, traffic, lights, or vibration being caused as a result of Mr. Luedeke's home occupation. <br />Staff has varied the day, time, and location of their inspections of the property. Staff has also not <br />received any official complaints in over a year regarding Mr. Luedeke's home occupation. If <br />approved, Exhibit A of the existing IUP would be revised to reflect the building addition. The <br />property in question is currently zoned Future Urban Service (FUS). <br />Knauss inquired about current screening of the property from the road. Rachel directed Knauss <br />to the landscaping plan of the property to note the 14'-18' Black Hills Spruce the applicant had <br />planted in the yard to provide screening from the road. <br />Commissioner Kleissler opened the public hearing. <br />John Olsen, 70977 177th Street North requested information about the time of business allowed <br />by the current Interim Use Permit (IUP). Rachel informed commission and Mr. Olsen that the <br />current Interim Use Permit (IUP) allowed for work to be conducted from 7:OOAM — 9:OOPM <br />each day. Mr. Luedeke was however only open from 8:OOAM — 8:OOPM each day. Mr. Olsen <br />stated he felt there was increased traffic on 177th Street as a result of Mr. Luedeke's home <br />occupation, and that he could hear excessive noise from his home coming from the general <br />direction of Mr. Luedeke's property. <br />Ellen St. Sauver informed the commission that she was a local farmer in the area and that <br />businesses like Mr. Luedeke's were essential to their operation. More specifically the time <br />allowed to complete work was important because when equipment goes down on a farm <br />operation it is imperative that it is fixed immediately. <br />Terry Luedeke, the applicant, stated that he was not directing any of his clients to use 177th street <br />to access his business. He stated that all of his test driving took place on County Road 4 by way <br />of Henna Avenue N, and that the increase in traffic likely was a result of the roundabout <br />construction. <br />McRoberts requested staff continue to monitor the property to ensure compliance with the <br />Interim Use Permit (IUP). <br />Knauss stated that the Interim Use Permit (IUP) was meeting all criteria required of it, and that <br />the proposed addition would only further mitigate potential impacts on neighboring properties. <br />Commissioner Kleissler closed the public hearing. <br />McRoberts made a motion, seconded by Arcand, to approve the Interim Use Permit (IUP) <br />Amendment to allow for the addition to the existing accessory structure. <br />All ayes, motion carried. <br />
